CHAPTER 549
AN ACT to amend the Code of 1950 by adding a section numbercd
21-116.1, authorizing the contraction of the boundaries or re-
duction of the area of sanitary districts in certain counties,
and prescribing the procedure therefor.

Be it enacted by the General Assembly of Virginia:
1. That the Code of 1950 be amended by adding a section num-
bered 21-116.1, as follows:
§ 21-116.1. The circuit court, or the judge of such court in
vacation, of any county adjoining a county having a population in
excess of two thousand per square mile, in which a sanitary dis-
trict has been created under this chapter, upon the petition of the
board of supervisors or other governing body of the county and of
twenty-five per centum of the qualified voters residing within the
limits of the territory proposed to be severed, may make an order
altering the boundaries of and reducing any sanitary district created
under the provisions of this chapter, which order shall prescribe
the metes and bounds of the territory to be severed; provided, how-
ever, that no such order shall be made if any bonds of the sanitary
district have theretofore been issued and have not been redeemed
in full as of the date of the petition requesting such reduction of
the sanitary district, or if any system or systems have been estab-
lished and are in operation under the provisions of this chapter as
amended, in the territory proposed to be severed as of the date of
the petition requesting such reduction of the sanitary district.
Upon the filing of such petition the procedure shall conform to
§§ 21-114, 21-115 and 21-116 of this Code, and the provisions of such
sections shall apply, mutatis mutandis, to proceedings under this
section.
