CHAPTER 441
AN ACT to authorize the Board of Visitors of The Virginia Poly-
technic Institute to sell certain lands at private or public sale,
and to appropriate the proceeds from the sale of any such
lands to the general fund of the State treasury.

Be it enacted by the General Assembly of Virginia:
1. That the Board of Visitors of The Virginia Polytechnic Insti-
tute be and they are hereby authorized to sell at public auction or
sale, or at private sale, at such price and upon such terms as they
may deem appropriate, all of the lands which were conveyed to said
Institute by deeds from Shenandoah Valley Apple, Cider and
Vinegar Corporation bearing dates October twenty-second, nine-
teen hundred forty, and October fifth, nineteen hundred forty-three,
and recorded in the clerk’s office of the Corporation Court of Win-
chester, Virginia, and being the same lands which were conveyed
to Shenandoah Valley Apple, Cider and Vinegar Corporation, by
deed from Edgar L. Fries and wife, recorded in the clerk’s office in
Deed Book thirty-four at page four hundred four. Said sale and
conveyance which is hereby authorized of said land to any pur-
chaser or purchasers shall be subject to the reservations and con-
ditions contained in the deed to the said Institute above referred
to, and there shall also be excepted from any such sale and con-
veyance any lands which have been granted to the State Highway
Commission for the purpose of widening the State highway, or
which the State Highway Department has been given the right,
either by deed or otherwise, to use for widening said highway
whether by verbal agreement or otherwise.
2. The proceeds of any sale or sales made under this act shall
be paid into the general fund of the State treasury.
