CHAPTER 432
AN ACT to amend the Code of 1950 by adding a section numbered
15-274.1, providing that zoning ordinances shall not become
effective in certain counties unless and until approved by the
voters in an election; and prescribing the procedure for calling
and holding such elections.

Be it enacted by the General Assembly of Virginia:
1. That the Code of 1950 be amended by adding a section num-
bered 15-274.1, as follows:
§ 15-274.1. Power of board as to zoning ordinances.—The
board of county supervisors of any county which has adopted the
county executive form of organization and government provided for
in this article shall have the same powers as to zoning ordinances
as is provided by general law subject, however, to the following
conditions. No zoning ordinance adopted by such board shall be
effective unless and until the same shall have been approved by the
qualified voters of the county voting at an election called and held
as hereinafter provided.
When any such ordinance is adopted, the clerk of the board
shall arrange for publication thereof at least once a week for three
successive weeks in some newspaper of general circulation in the
county and shall notify the judge of circuit court of the county
of the passage of the same, who shall issue a writ of election direct-
ing the regular election officials of the county on a day fixed in such
writ to open a poll and take the sense of the qualified voters of the
county on the question: Shall the zoning ordinance adopted by the
board of county supervisors on the.......... day of..............
become effective?
The election shall be held, the results ascertained and certified,
as provided in § 24-141 of the Code of Virginia. If the majority
of the voters voting in the election vote in favor of such ordinance
becoming effective, the same shall be in effect from the day such
result is certified to the clerk of court by the commissioners of
election.
