AN ACT to amend and reenact § 15-766 of the Code of 1950,
relating to alteration and vacation of streets and alleys.

Be it enacted by the General Assembly of Virginia:
1. That § 15-766 of the Code of 1950 be amended and re-
enacted as follows:
§ 15-766. Alteration and vacation of streets and alleys.—
Streets and alleys may be altered or vacated in the manner
provided by §§ 33-156 to 33-158 or other provision of law for
the alteration and discontinuance of county roads. In the alter-
ation and vacation of such streets and alleys in cities and towns
the council shall exercise the same powers as are granted to
and vested in the boards of supervisors of counties by general
law in relation to the discontinuance of county roads and land-
ings; which shall be in addition to the powers contained in the
charter of any city or town and any powers now had by such
governing bodies under the common law or by statute; pro-
vided that the notice so required to be posted may be posted on
the first day of the term of either the circuit, corporation or
hustings court, at the courthouse or courtroom thereof, and at
two public places in the city or town at least five days before
the council appoints the viewers; and the appeal, if any, shall
be to the court at the courthouse or courtroom of which the
notice was posted. All proceedings which have been instituted
and concluded in the manner prescribed by this section are
validated to the same extent as if they had been expressly con-
ducted hereunder and any such pending proceedings may be
conformed to and continued under the provisions of this sec-
tion without necessity of discontinuance and institution of a
new proceeding.
