CHAPTER 299
AN ACT to amend and reenact §§ 838-88 and 38-89 of the Code
of 1950, relating to power and authority of the State High-
way Commission as to limited access highways, so as to
require the Commissioner to extinguish certain easements
in connection with such highways.

Be it enacted by the General Assembly of Virginia:
1. That 8§ 33-38 and 33-39 of the Code of 1950 be amended
and reenacted as follows:
§ 33-38. Power and authority of Commission.—The State
Highway Commission may plan, designate, acquire, open, con-
struct, reconstruct, improve, maintain, discontinue and regulate
the use of limited access highways, in the same manner in which
it is now or may be authorized to plan, designate, acquire, open,
construct, reconstruct, improve, maintain, discontinue and regu-
late the use of other highways within this State. The Commis-
sion shall also have any and all other additional authority and
power relative to such limited access highways as is vested in
it relative to other highways, which shall include the right to
acquire by purchase, eminent domain, grant or dedication title
to such lands or rights of way for such limited access highways.
§ 33-39. Designating existing highway as limited access
highway.—The Commission may designate an existing highway
as or included within a limited access highway. *
Notwithstanding any other provisions of this section all
existing easements of access, light or air, shall be extinguished
by the Commission where necessary and service roads shall be
constructed in accordance with the plans and specifications of the
Commission.
