CHAPTER 287
AN ACT to authorize the State Treasurer and the Comptroller
to make refund to the Veterans’ Administration of certain
moneys in the custody of the State Treasurer, and to pro-
hibit the payment of certain outstanding checks. H2177

Whereas, the State Treasurer is the custodian and disburs-
ing officer for the Unemployment Compensation Commission of
Virginia which acts as agent for the Administrator of Veterans’
Affairs in the administration in this State of Title V of the
Servicemen’s Readjustment Allowance Act of 1944 (Public Law
346, 78th Congress) ; and,
Whereas, various checks, aggregating a total amount of
ten thousand, four hundred fifty-six dollars ($10,456.00), issued
by the State Treasurer for the payment of readjustment allow-
ances to veterans have not been presented for payment within
one year from the date of issuance and have been charged
off as required by the provisions of § 2-158 of the Code of Vir-
ginia of 1950; and,
Whereas, said amount of $10,456.00 consequently remain-
ing in the custody of the State Treasurer was derived solely
from grants made by the Veterans’ Administration for the pur-
pose of paying readjustment allowances; and,
Whereas, the State Treasurer is doubtful of his authority
under existing statutes to make refund and return to the Vet-
erans’ Administration of the said amount of $10,456.00, now in
his custody ; now, therefore,
Be it enacted by the General Assembly of Virginia, as
follows:
1. (a) That the Treasurer of Virginia be, and he is here-
by, authorized to make refund and return to the Veterans’ Ad-
ministration of the said sum of $10,456.00, less any payments
made upon checks presented before the actual refund is made.
(b) The Comptroller is hereby authorizec to issue such
warrants and perform any other functions required of his office
necessary to enable the State Treasurer to make said refund.
(c) After said refund has been made to the Veterans’ Ad-
ministration by the State Treasurer all of the checks so charged
off resulting in the accumulation of said amount so refunded
shall forever be barred from payment by the State Treasurer.
