AN ACT to amend and reenact § 8-61, § 8-62 and § 8-65 of the
Code of 1950, relating to filing of power of attorney for
service upon cooperative nonprofit life benefit corporations
and service of process under same and how process 1s other-
wise served.

Be it enacted by the General Assembly of Virginia:
1. That § 8-61, § 8-62 and § 8-65 of the Code of 1950 be
amended and reenacted as follows:
§ 8-61. Every foreign cooperative nonprofit life benefit cor-
poration, before it shall be permitted to transact business in
this State, shall appoint in writing the * Secretary of the Com-
monwealth, and his successor in office, to be its true and lawful
attorney on whom all legal process and legal notices in any
action or proceeding against it in this State shall be served, and
in such writing shall agree that any lawful process against it
which is served upon such attorney shall be of the same legal
force and validity as if served upon such corporation, and that
the authority of such attorney shall continue in force so long
as any liability remains outstanding in this State.
§ 8-62. Copies of such appointment, certified by the *
Secretary of the Commonwealth shall be deemed sufficient evi-
dence thereof and shall be admitted in evidence with the same
force and effect as the original. Service of process in all suits
and proceedings against any such foreign corporation shall be
made only upon such attorney and must be made in duplicate
upon him, or in his absence upon the person in charge of his
office, and shall be deemed sufficient service upon such corpora-
tion; provided that no such service shall be deemed valid or
binding against any such corporation when it is required there-
under to file its answer, pleading or defense in less than thirty
days from the date of mailing a copy of such service to such
corporation. When legal process against any such corporation
is served upon the * Secretary of the Commonwealth he shall
forthwith forward by registered mail one of the duplicate copies,
directed to its secretary or corresponding officer at the home
office of the corporation. * Service of process in all suits against
such domestic corporations shall be in the manner provided by
the laws of this State for other domestic corporations.
§ 8-65. Service on any person other than the Secretary
of the Commonwealth * under any of the six preceding sections
of this chapter shall be by delivering to him a copy of the process
cr notice in the county or city wherein he resides or his place
of business is, or the principal office of the corporation is
located; and the return shall show this, and state on whom and
when the service was; otherwise, it shall not be valid. The term
“agent”, as employed in any of the six preceding sections, shall
be construed to include a depot or station agent of a railroad
company, a telegraph or telephone operator of a telegraph, tele-
phone or railroad company, and a tollgatherer of a canal
company.
