AN ACT to amend the Code of 1950 by adding in Chapter 4 of Title
32 an article numbered 5 containing two sections numbered
32-104.1 and 32-104.2, providing that certain records of cancers
and tumors may be made available to the State Health Depart-
ment and prohibiting publication of such information.

Be it enacted by the General Assembly of Virginia:
1. That the Code of 1950 be amended by adding in Chapter 4 of
Title 32 an article numbered 5 containing two sections numbered
32-104.1 and 32-104.2, as follows:
§ 32-104.1. Records of hospitals and clinics—Each hospital
and clinic may make available to the State Department of Health
or its agents abstracts of their records of patients having malig-
nant tumors or cancers. Such abstracts may include the name,
address, sex, color and any other perfinent identifying information
regarding each such patient.
§ 32-104.2. Confidential nature of information supplied.—
The State Department of Health and each officer and employee
thereof shall keep all information submitted in accordance with
the preceding section confidential. No publication of any such
information except in the form of statistical or other studies
without identification of individual cases, shall be made. Violation
of any provision of this article shall be a misdemeanor.
