CHAPTER 124
AN ACT to approve, confirm, and ratify a certain deed dated the
28th day of August, 1947, from J. A- Anderson, Chairman,
State Highway Commission, on behalf of the Commonwealth
of Virginia, to A. L. Lindsey in exchange for land needed
for public highway purposes, in Bermuda Magisterial Dis-
trict, Chesterfield County, Virginia, and vesting title in A.
L. Lindsey.

Whereas, in relocating a section of State Highway Route No.
10, designated as Project No. 1156-A, 1-K, in Bermuda Magis-
terial District, Chesterfield County, Virginia, it became neces-
sary and desirable to exchange a portion of the right of way of
said Route No. 10 for a strip or parcel of land belonging to A.
L. Lindsey and needed for the relocation of said section of Route
No. 10; and
Whereas, the Commonwealth of Virginia, acting by and
through the Department of Highways, entered into an agree-
ment with the said A. L. Lindsey to release, quitclaim, and con-
vey to him the said portion of the right of way of Route No. 10
in exchange for a conveyance by the said A. L. Lindsey to the
Commonwealth of Virginia of a strip or parcel of land needed
for the relocation of said section of Route No. 10, which agree-
ment is of record in the Clerk’s Office of the Circuit Court of
Chesterfield County, Virginia, in Deed Book 317, Page 84 to 92,
both inclusive; and
Whereas, in accordance with the said agreement the said A.
L. Lindsey and wife conveyed to the Commonwealth of Virginia
the said strip or parcel of land for the said relocation of Route
No. 10 by deed dated the 21st day of May, 1947, of record in the
said Clerk’s Office in Deed Book 320, Page 390; and by deed
dated the 28th day of August, 1947, of record in the said Clerk’s
Office in Deed Book 320, Page 388, J. A. Anderson, Chairman,
State Highway Commission, acting under authority of a resolu-
tion of the State Highway Commission, did, on behalf of the
Commonwealth of Virginia, execute and deliver a deed intended
to release, quitclaim, and convey said portion of the right of way
of Route No. 10 to the said A. L. Lindsey; and
__ Whereas, no person or persons resided along the said por-
tion of the right of way of Route No. 10 released, quitclaimed,
and conveyed to the said A. L. Lindsey and he and the County
of Chesterfield were the sole owners of the land along the said
portion of the right of way of Route No. 10, and a suitable pro-
vision and reservation for public access from the land of the
County of Chesterfield, upon which is located the Chesterfield
County Public Library, across the said portion of the right of
way of Route No. 10 to the said relocation of Route No. 10, was
provided for in the said resolution of the State Highway Com-
mission and in the said deed, therefore, it was not deemed neces-
sary that notice be given to the said owners as provided for by
Chapter 10, Acts of the General Assembly of Virginia, approved
February 7, 1940; and
Whereas, it is the desire of the State Highway Commission-
er of Virginia and the said A. L. Lindsey that the said agree-
ment between them be completely consummated as agreed; now,
therefore
Be it enacted by the General Assembly of Virginia:
1. That the said deed executed by J. A. Anderson, Chair-
man, State Highway Commission, dated the 28th day of August,
1947, of record in the Clerk’s Office of the Circuit Court of
Chesterfield County, Virginia, in Deed Book 320, Page 388, in-
tending to release, quitclaim, and convey all of the right, title, and
interest of the Commonwealth of Virginia in the portion of what
is now the old location and right of way formerly occupied by
Route No. 10 as described in said deed to the said A. L. Lindsey
be and the same is hereby approved, confirmed, and ratified, and
said deed is declared to release, quitclaim, and convey all of the
right, title, and interest of the Commonwealth of Virginia, in
said portion of the old location and right of way of Route No. 10
to the said A. L. Lindsey, subject to the said provision and reser-
vation therein contained.
2. An emergency is declared to exist and this Act shall be
in force from its passage.
