CHAPTER 117

AN ACT to amend the Code of 1950 by adding a section num-
bered 27-85.1, to provide that the person officially in charge
at scenes of fires may take and preserve certain property,
and conditions of restitution.

Be it enacted by the General Assembly of Virginia:
1. That the Code of 1950 be amended by adding a section
numbered 27-85.1 as follows:

§ 27-85.1.—The person officially in charge of firefighters
at the scene of any fire is authorized and empowered to take and
preserve any property which indicates that the fire was inten-
tionally set. Any person whose property is so held may petition
the circuit court of the county or the circuit or corporation
court of the city within which the property was taken or the
judge thereof in vacation for return of the property, and the
court may order restitution upon such conditions as are appro-
priate for preservation of evidence, including posting of bond.
