CHAPTER 116
AN ACT to authorize the State Corporation Commission of Vir-
ginia to prescribe uniform regulations for safety in the de-
sign, construction, location, installation and operation of
equipment for storing, handling, transporting by tank truck
or tank trailer and utilizing liquefied petroleum gases for
fuel purposes, and for the odorization of said gases used
therewith; prohibiting certain acts and prescribing the
penalty therefor; to provide for the marking of liquefied
petroleum gas containers and to prohibit the refilling or
use of such containers without authorization by the owner
thereof; to prohibit the adoption of ordinances or regula-
tions in conflict with this act, and to provide for enforce-
ment of the act and regulations.

Be it enacted by the General Assembly of Virginia:
1. § 1. The term “Liquefied Petroleum Gas”, as used in this
act, means and includes any material which is composed pre-
dominantly of any of the following hydrocarbons, or mixtures
of the same; propane, propylene, butanes (normal butane or
isobutane), and butylenes.
§ 2. The State Corporation Commission, hereinafter re-
ferred to as the Commission shall make and promulgate regula-
tions setting forth minimum general standards covering the
design, construction, location, installation, and operation of
equipment for storing, handling, transporting by tank truck,
tank trailer, and utilizing liquefied petroleum gases and requir-
ing the odorization of said gases and the degree thereof. Said
regulations shall be such as are reasonably necessary for the pro-
tection of the health, welfare and safety of the public and per-
sons using such materials, and shall be in substantial conformity
with the generally accepted standards of safety concerning the
same subject matter. Such regulations shall be adopted by the
Commission only after a public hearing thereon.
Regulations in substantial conformity with the published
standards of the National Board of Fire Underwriters for the
design, installation and construction of containers and pertinent
equipment for the storage and handling of liquefied petroleum
gases as recommended by the National Fire Protection Associa-
tion shall constitute substantial conformity with the generally
accepted standards of safety concerning the same _ subject
matter.
§ 3. All equipment for storing, handling and transporting
liquefied petroleum gas shall be installed and maintained in a
safe operating condition and in conformity with the rules and
regulations of the Commission adopted under this act.
§ 4. All law enforcement officers are hereby charged with
the enforcement of this act and of the regulations adopted
hereunder.
§ 5. It shall be unlawful for any person, firm, association,
or corporation, on and after the effective date of this act to
violate any of the provisions hereof or of the regulations of the
Commission made pursuant hereto. Any person, firm, associa-
tion, or corporation violating any of the provisions of this act,
or the regulations made hereunder shall be deemed guilty of a
misdemeanor, and, upon conviction thereof, shall be punished
by a fine of not more than one hundred dollars ($100.00).
