AN ACT to direct the Virginia Code Commission to include the
Rules adopted by the Supreme Court of Appeals on October
18, 1949, in the 1950 pocket supplement to the Code of
1950 and to provide that such rules shall supersede statu-
tory provisions in conflict therewith. [H 58 ]
Approved February 3, 1950
Whereas the Supreme Court of Appeals on October 13, 1949,
adopted certain rules governing practice and procedure in suits
in equity, actions at law, pre-trial conferences and appellate
proceedings, which rules are recognized as within the rule mak-
ing power of the Court and will on their effective date, February
1, 1950, supersede all statutory provisions then existing in con-
flict therewith; Now, Therefore,
Be it enacted by the General Assembly of Virginia:
1. The Virginia Code Commission is directed to include the
rules adopted by the Supreme Court of Appeals, effective Febru-
ary one, nineteen hundred fifty, in the nineteen hundred fifty
pocket supplement of the Code of nineteen hundred fifty, and
cause them to be properly indexed and annotated.
2. The rules so adopted shall supersede all statutory provisions
in conflict therewith.
3. In order to avoid any possible confusion which may be
thought to exist in the period between February 1, 1950, and
the normal effective date of acts passed at the current session,
an emergency is declared to exist and this act shall be effective
on and after February 1, 1950.
