Chap. 69.—An ACT to amend the Code of Virginia by adding thereto a new sec-
tion numbered 2769-a relating to the compensation and mileage of members of
boards of supervisors and to repeal Section 2769 on the same subject. [S 108]

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding a new sec-
tion numbered twenty-seven hundred and sixty-nine-a as follows:
Section 2769-a. Compensation and mileage of supervisors.—(a)
Each member of the board of supervisors of each county shall be
allowed and paid out of the county levy an annual salary, to be fixed
as herein provided, for his services in attending the meetings of
the board and in discharging the duties imposed by law upon him.
(1) The total annual amount to be allowed as compensation for
the entire membership of the board of supervisors of each county
shall be fixed by the judge of the circuit court of such county, in term
or vacation, by an order entered of record in the common law order
book, within the following limits; in any county having a popula-
tion, according to the last preceding United States census, of not
more than twenty thousand, such total shall not exceed twelve hun-
dred dollars ; in each county having in excess of twenty thousand, but
not more than twenty-six thousand, such total shall not exceed fif-
teen hundred dollars; in each county having in excess of twenty-
six thousand, but not more than forty thousand, such total shall
not exceed two thousand dollars, provided that in each such county
having seven magisterial districts, such total shall be not less than
seventeen hundred and fifty nor more than two thousand, one hun-
dred dollars, and provided that in any county having a population
in excess of twenty thousand and not in excess of twenty thousand
two hundred ninety, such total may amount to but shall not exceed
twenty-four hundred dollars; and in each county having in excess
of forty thousand such total shall not exceed twenty-five hundred
dollars, except that in any county having a population in excess of
forty thousand, adjoining a county having a density of population
in excess of one thousand per square mile, according to the last
preceding United States census, the annual salary of each mem-
ber of the board of supervisors shall not be less than six hundred
dollars and not more than twelve hundred dollars, exclusive of
mileage, and except that in each county having in excess of forty
thousand and having eight or more magisterial districts, such
total shall not be less thay twenty-two hundred dollars, and
except that in counties in excess of fifty-five thousand in popu-
lation, such salary shall not be less than twenty-five hundred dol-
lars. Provided, that in any county having a population of more than
twenty-two thousand, but less than twenty-two thousand, six hun-
dred, the annual compensation of each member of the board of
supervisors shall be four hundred dollars a year with an addi-
tional one hundred dollars a year for the chairman of the board.
Provided, that in counties which have a population of thirty thou-
sand inhabitants or more and the board of supervisors of which has
the duty of supervising the operation of ferries owned in whole or in
part by the county, the compensation of each member of the board
of supervisors shall be not less than five hundred dollars per annum
for each member of the board and not more than eight hundred
dollars per annum for each member of the board and the com-
pensation shall be provided for in accordance with the provisions of
this section; and provided further, that in any county having a pop-
ulation of not more than thirty thousand and adjoining a city having
a population of more than one hundred thousand but less than one
hundred and fifty thousand, and in any county adjoining both a city
having a population in excess of forty thousand and a county con-
taining. wholly within its boundaries a city having a population in
excess of sixty thousand, the annual compensation of each member
of the board of supervisors shall be not less than two hundred fifty
dollars nor more than five hundred dollars, and in any county hav-
ing a population of not less than thirteen thousand or more than
thirteen thousand, six hundred, and having five magisterial districts
the compensation of each member of the board of supervisors shall
be not less than two hundred and forty dollars, nor more than three
hundred and fifty dollars, and provided further, that in counties
adjoining cities lying wholly within the State of Virginia having a
population of not less than one hundred and seventy thousand in-
habitants according to the last preceding United States census the
compensation of each member of the board of supervisors shall not
be less than three hundred dollars, nor more than seven hundred
fifty dollars per annum; and provided further, that in any county
having a population of more than twenty-six thousand, five hundred,
but less than twenty-six thousand, nine hundred and in any county
having a population of more than twenty-one thousand, two hun-
dred fifty, but less than twenty-one thousand, nine hundred and ina
county having a population of more than thirty-one thousand, three
hundred, but less than thirty-one thousand, nine hundred, the com-
pensation of each member of the board of supervisors shall not be
more than four hundred fifty dollars per annum for each member of
the board ; provided, that in any county having a population of more
than twelve thousand, three hundred, but less than twelve thou-
sand, six hundred, the annual compensation of each member of the
board shall be not less than three hundred dollars a year with sev-
enty-five dollars additional annually for the chairman of the board.
For the purposes of this section, the population and area referred
to shall be that shown by the last preceding United States census.
(2) The annual compensation to be allowed each member of
the board of supervisors of any county shall be determined by divid-
ing the total amount allowed the entire board in accordance with
the provisions of the last preceding paragraph by the number of su-
pervisors in the county. Provided, however, in any county that has
a density of population of more than fifty-three and less than fifty-
five inhabitants to the square mile within the geographical “boun-
daries of which is located a city on a navigable river having a pop-
ulation of not less than ten thousand, nor more than twenty thou-
sand inhabitants by the last preceding United States census, the
total annual amount to be allowed as compensation for the entire
membership of the board of supervisors of such county shall be fixed
in accordance with the terms of this section at not more than two
thousand dollars; and, provided, further, that in any county hav-
ing therein properties of public service corporations assessed for
taxation at an aggregate valuation of more than six million dollars,
the annual compensation of each member of the board of supervisors
shall be not less than four hundred fifty dollars, nor more than six
hundred dollars; and, provided further, that in any county that has
a population of not less than seven thousand inhabitants and a den-
sity of population of not less than twenty-six per square mile, in
which county is located a port on a navigable river, the total annual
amount to be allowed as compensation for the entire membership of
the board of supervisors of such county shall be fixed in accordance
with the provisions of this section at not more than twelve hundred
dollars, provided that in counties having a population of more than
eighty-five hundred, but not more than eighty-eight hundred fifty,
according to the last preceding United States census, and an area
of more than one hundred thirty-three square miles, but not more
than one hundred forty-eight square miles, and having not more than
three magisterial districts, the annual compensation of each member
‘of the board of supervisors, including mileage, shall be not less than
three hundred dollars nor more than four hundred dollars; and, pro-
vided further, that in any county adjoining the State of North Caro-
lina and having a population of more than twenty thousand, but less
than twenty-six thousand according to the last preceding United
States census, and having located partially within its boundaries a
town lying partly in such county and partly in another county, the
total annual amount to be allowed as compensation for the entire
membership of the board of supervisors shall be fixed in accordance
with the provisions of this section at not more than two thousand
dollars; and, provided further, that in any county adjoining two
cities of the first class, one of which is located within the geograph-
ical boundaries of said county, and on a navigable river, and in which
county is located a military camp or fort, the annual compensation of
each member of the board of supervisors shall be not less than three
hundred dollars, nor more than three hundred and fifty dollars; and,
provided further, that in any county adjoining the State of North
Carolina and having a population of more than eighteen thousand,
two hundred fifty, but less than nineteen thousand seven hundred
fifty, according to the last preceding United States census, and hav-
ing located partially within its boundaries a town lying partly in
such county and partly in another county, the total annual amount
to be allowed as compensation for the entire membership of the
board of supervisors shall be fixed in accordance with the provisions
of this section at not more than two thousand five hundred dollars ;
and, provided further that in any county having a population of
more than twenty-one thousand three hundred, but less than twen-
ty-two thousand or having a population of more than twenty-five
thousand three hundred, but less than twenty-six thousand the an-
nual compensation of each member of the board shall not be less
than four hundred eighty dollars nor more than nine hundred dol-
lars per annum with an additional sixty dollars per annum for the
chairman of the board ; and, provided further that any county having
a population of more than eighteen thousand, but less than eighteen
thousand, five hundred and adjoining a city of the first class having
a population of more than thirty thousand, the annual compensation
of each member of the board shall not be less than three hundred
dollars each or more than six hundred dollars each.
(b) In addition to the foregoing compensation each member
of the board of supervisors shall be allowed and paid out of the
county levy five cents for each mile of travel required in going to
and returning from the place of meeting of the board, provided that
only one mileage shall be allowed for each term or meeting of the
board; and, provided, further, that mileage shall not be allowed for
more than twenty-four meetings in any year.
(c) Nothing in this section shall apply to any county which has
adopted or may hereafter adopt any form of county organization and
government provided for in sections twenty-seven hundred seventy-
three-a to twenty-seven hundred seventy-three-n, both inclusive, of
the Code of Virginia.
2. That section twenty-seven hundred sixty-nine of the Code of
Virginia is repealed.
