Chap. 55.—An ACT to authorize and empower the State Highway Commission
of Virginia, in its discretion, to pay and settle claims and demands arisi
as a result of damages sustained to personal property by reason of wor!
projects or the operation of State owned or operated equipment when the
same is being used in the construction, reconstruction or maintenance of State
highway system, and to provide, if said commission, in its discretion, refuses
the payment of any such claims or demands, no legal liability upon the State
to pay such claims or demands shall be imposed. (H 136]

Be it enacted by the General Assembly of Virginia:
1. That the State Highway Commission of Virginia is author-
ized and empowered, in its discretion, to pay and settle claims
and demands against the Commonwealth arising as a result of
damages sustained to personal property by reason of work projects
or the operation of State owned or operated equipment when en-
gaged in the construction, reconstruction, or maintenance of the
tate highway system, unless said claims or demands arise as a
result of negligence of the person or persons asserting such claims
or demands. Nothing herein contained shall be construed as impos-
ing any legal liability upon the State to pay such claims or demands,
nor as giving the consent of the Commonwealth to be sued in any
action or suit to recover on such claims or demands in the event
the said commission refuses payment of said claims or demands.
