Chap. 5.—An ACT to amend and reenact Section 5 of Article II of Chapter 446
of the Acts of Assembly of 1930 ap approved March 27, 1930, known as the
Military Code of Virginia, the section relating to the Adjutant General.

Be it enacted by the General Assembly of Virginia:
1. That section five of article II of chapter four hundred forty-
six of the Acts of Assembly of nineteen hundred thirty, approved
March twenty-seven, nineteen hundred thirty, be amended and
reenacted as follows:
Section 5. - Adjutant General—-The Adjutant General shall
be in direct charge of the Division of Military Affairs and shall be
responsible to the Governor and Commander-in-chief for the proper
performances of his duties. All the powers conferred and the duties
imposed by law upon the Adjutant General shall continue to be
exercised or performed by him under the direction and control of
the Governor.
The Governor shall appoint an Adjutant General to serve at the
pleasure of the Governor with the rank of brigadier general or
major general as the Governor may prescribe and who shall have
had not less than five years commissioned service in the Virginia
national guard, and who, while holding such office, may be a member
of the national guard. The Adjutant General shall receive a salary
prescribed by law, not to exceed the salary for the biennium ending
June thirtieth, nineteen hundred forty-eight.
