Chap. 488.—An ACT to create a special fund and to provide for the payment
into such fund of all aviation fuel taxes, to the extent of the tax imposed by
law, collected by the Motor Vehicle Division, and for the payment into such
fund of all funds accumulated from certain fees imposed under the laws of
this State, to provide for the expenditure of the special fund so accumulated
by the State Corporation Commission for the administration by the Com-
mission, through the Division of Aeronautics, of the laws pertaining to
aviation, as now or as may be hereafter enacted and jurisdiction for the
administration thereof conferred on the said Commission; to provide for the
expenditure by the said State Corporation Commission of the surplus of the
funds so created left after the expenses of the administration for the construc-
tion, maintenance and improvement of airports and landing fields, to which
the public shall have access, all in accordance with applicable laws; and for
the promotion of aviation in the interest of operators and in the interest of
the public and to provide against the diversion of such fund for other than
aviation purposes. [S 69]

Be it enacted by the General Assembly of Virginia:
1. Section 1. On and after the effective date of this act, all funds
accumulated from any sales tax, excise tax or use tax, now or which
may hereafter be imposed under the laws of this State on aviation motor
fuel purchased or used in this State in the propulsion of aircraft, and all
funds heretofore or hereafter accumulated from any fees for licensing
or registering of airmen, aircraft and airports, now or hereafter imposed
under the laws of this State, and all funds heretofore, and which may
hereafter be, appropriated to the State Corporation Commission for
the purpose of the promotion and development of aviation and airports,
including the expense of the administration by the Commission through
the Division of Aeronautics of the laws pertaining to aviation, as now
or as may be hereafter enacted, and the jurisdiction for the administration
thereof conferred on the said Commission, be, and they hereby are,
constituted a special fund for the administration of the aviation laws,
heretofore or hereafter enacted, insofar as the administration has been,
or shall be, imposed upon the State Corporation Commission, for the
construction, maintenance and improvement of airports and landing
fields and for the promotion of aviation in the interest of operators and
in the interest of the public, and that said funds, after reasonable and
necessary cost of administration of said aviation laws by the State Cor-
poration Commission, through medium of the said Division, and by the
State Corporation Commission directly, or otherwise, as may be deter-
mined, shall be expended and dispersed by order of the State Corporation
Commission, through medium of warrants drawn by the Comptroller
of the State of Virginia, for the construction, maintenance and improve-
ment of airports and landing fields, to which the public now has, or
which it is proposed shall have, access, and for the promotion of aviation
in the interest of operators generally.
Section 2. That the special fund hereby created and provided for
shall be so set up on the books of the Comptroller of the State of Vir-
ginia as to segregate the amounts paid into the said fund as a direct tax
upon aviation motor fuel purchased by operators of airplanes and aircraft,
and that no portion of such fund, accumulated in the manner herein-
before provided, shall ever be used for any other purpose than for the
administration of the aviation laws and the construction, maintenance
and improvement of airports and landing fields, and that no portion of
the same shall be covered into the general fund of the State treasury,
said funds derived in the manner aforesaid being hereby irrevocably
appropriated for promotion of aviation in the interest of operators and of
the public, as herein provided, and to the extent necessary only, for the
administration of this and other aviation laws; and provided further,
that only such portion of the salaries and other compensation of members
of the personnel of the Commission as are proportionate to the time
devoted to the administration of this and other aviation laws, shall be
charged against said special fund.
Section 3. No part of this fund shall be used for recurring expendi-
tures on any airport or landing field under this act.
2. This act shall become effective July one, nineteen hundred
forty-eight.
