Chap. 483.—An ACT to amend and reenact Section 94, as heretofore amended,
of an act entitled, “An Act to incorporate the city of Newport News in the
county of Warwick, and to provide a charter therefor”, approved January
Sixteen, 1896, the said section relating to the election of the city attorney;
powers and duties generally; statements of claim against city for negligence;
and empowering the city, in its discretion, to elect an assistant city attorney;
powers and duties generally. (H 538]

Be it enacted by the General Assembly of Virginia:
1. That Section ninety-four, as heretofore amended, of an act
entitled “An Act to incorporate the City of Newport News in the county
of Warwick, and to provide a charter therefor”, approved January
erect Eighteen Hundred Ninety-six, be amended and reenacted as
ollows:
Section 94. Election of city attorney and assistant city attorney;
powers and duties generally; statement of claim against city for negli-
gence.—There shall be one city attorney who shall be the director of the
department of law. He shall be elected by the council as and for the
term in this act provided. He shall commence and prosecute all and
every suit or suits, action or actions brought by the city for or on account
of the estate, rights, trusts, privileges, claims, or demands of the same,
and defend all actions or suits brought against the city or any official
thereof before any court of this Commonwealth. All matters of law to
which the city may be a party, or in anywise interested, shall be under
his supervision, direction and control, subject to the direction of the
council.
The council is hereby authorized and empowered in its discretion to
elect an assistant city attorney, to serve at the pleasure of the city
attorney, who shall be a resident citizen of the said city of Newport News
and shall have been admitted to practice in the courts of the Common-
wealth; he shall be recommended by the city attorney, and shall qualify
in a manner prescribed by law for the city attorney. He shall, so far
as required by the city attorney, discharge and perform any of the
duties now and hereafter imposed by law upon said city attorney, and
in the discharge of said duties, shall be under the direction and control
of such city attorney. He shall receive such compensation as may be
fixed by the council.
No action shall be maintained against the city for damages for an
injury to any person or property alleged to have been sustained by
reason of the negligence of the city, or of any officer, agent or employee
thereof, unless a written statement, verified by the oath of the claimant,
his agent or attorney, of the nature of the claim and of the time and
place at which the injury is alleged to have occurred or been received,
shall be filed with the city manager of said city within thirty days after
such cause of action shall have accrued. The city manager shall, upon
receiving such statement, make a full report of the circumstances to the
city attorney for appropriate action.
2. An emergency exists and this act is in force from its passage.
