Chap. 455.—An ACT to amend Chapter 361 of the Acts of Assembly of 1940,
approved March 30, 1940, as amended, relating to police departments in cer-
tain counties, by adding thereto a new section numbered 7, providing for a trial
board to hear char arges against police officers, and authorizing the adoption and
use of police manuals for such counties. {S 254]

Be it enacted by the General Assembly of Virginia:
1. That chapter three hundred sixty-one of the Acts of Assembly of
nineteen hundred forty, approved March thirty, nineteen hundred forty,
as amended, be amended by adding thereto a new section numbered
seven as follows:
Section 7. The governing body of any such county may create a
trial board to consist of three residents of the county appointed for terms
of four years each, and may fill vacancies on the board, whether caused
by expiration of terms or otherwise. Members of the board shall be
paid for their services at the rate of five dollars for each half day and
ten dollars for each full day given to the work of the board, such payment
to be made out of the county levy for the police department. The trial
board shall hear charges brought against any member of the police
force, and may suspend any member, with or without pay, for such
length of time as it may deem proper for any failure to perform his duty,
or for the commission of any offense against the criminal laws of this
or any other state or the District of Columbia or the United States, or
for any conduct unbecoming a conservator of the peace. Any member
of the police force aggrieved by any decision of the trial board shall
have the right of appeal to the judge of the circuit court of the county,
whose decision on such appeal shall be final.
The governing body of the county may adopt a police manual covering
the various duties and functions of police officers while on duty, and may
enforce the requirements of such manual by appropriate penalties.
