Chap. 421.—An ACT to amend and reenact Section 5 of Chapter 197 of the
Acts of Assembly of 1926, approved March 18, 1926 dealing with chan
in zoning regulations in cities and towns. (H 350)

Be it enacted by the General Assembly of Virginia:
1. That section five of chapter one hundred ninety-seven of the
Acts of Assembly of nineteen hundred twenty-six, approved March
eighteen, nineteen hundred twenty-six, be amended and reenacted as
follows:
Section 5. Such regulations, restrictions and boundaries may from
time to time be amended, supplemented, changed, modified or repealed.
In case, however, of a protest against such change signed by the owners
of twenty per centum or more either of the area of the lots included in
such proposed change, or of those adjacent in the rear thereof, or of
those directly opposite thereto, such amendment shall not become effec-
tive except by the favorable vote of three-fourths of all the members of
the council or other governing body of such city or town. The provisions
of the previous section relative to public hearings and official notice
shall apply equally to all changes or amendments. Provided that in
cities adjoining counties having a population of more than one thousand
per square mile, in case of a protest against such change signed by the
owners of twenty per centum or more either of the area within the
boundaries of such proposed change or of the area of any lots or tracts
any part of which lies within three hundred feet of such boundaries, such
change or amendment shall not become effective except by the favorable
vote of three-fourths of all the members of the council or other governing
body of such city or town.
