Be it enacted by the General Assembly of Virginia:
That section sixty hundred sixty-one of the Code of Virginia, be
amended and reenacted as follows:
Section 6061. Process to commence a suit, a summons; how
issued; not altered afterwards.—The process to commence a suit shall
be a writ commanding the officer to whom it is directed to summon the
defendant to answer the bill or action. It shall be issued on the written
order of the plaintiff, his attorney or agent, and shall not, after it is issued,
be altered, nor any blank therein filled up, except by the clerk. It shall be
deemed to have been issued upon receipt by the clerk of the writ tax,
clerk’s deposit and such order; and it shall be the duty of the clerk to
note upon such order the date it was received by him.
