of 1926, approved March 24, 1926, relating to commutation of certain estates
so as to regulate the procedure therein. (H 425]
Approved March 31, 1948
Be it enacted by the General Assembly of Virginia:
1. That chapter four hundred fifty-two of the Acts of Assembly of
nineteen hundred twenty-six, approved March twenty-four, nineteen
hundred twenty-six, be amended and reenacted as follows:
In any case in which under the laws of this State provision is made
for commutation in money of a life estate where all the parties interest-
ed are under no disability, such provision shall also apply where any of
the parties interested are under disability, and in any such latter case the
court, or the judge thereof in vacation, may, upon application of the
guardian, committee, or trustee, if any, and, if not, by a guardian ad
litem appointed by such court or judge, of any such person, on behalf
of his ward, and upon hearing evidence satisfactory to such court or
judge, enter an order authorizing such guardian, committee, trustee or
guardian ad litem, to consent on behalf of such person under disability
to such commutation. Such consent when so given shall be as valid
and effective as if the person on whose behalf it was given were sui
juris and had given such consent. All judicial orders and decrees here-
tofore entered authorizing any such commutation where persons under
disability were interested, are hereby validated and confirmed; provided
that nothing in this act contained shall be construed as intended to impair
any vested right.
