Be it enacted by the General Assembly of Virginia:
1. That chapter ninety-four of the Acts of Assembly of nineteen
hundred thirty-four, approved March seven, nineteen hundred
thirtv-four, and known as the Alcoholic Beverage Control Act be
amended by adding a section numbered thirty-one-b as follows:
Section 31-b. Local option in towns for which no population
is shown by latest United States census.—If the last preceding
United States census gives no figures for the. population of the city
or town with respect to which a petition ‘is filed under section
thirty of this act the petition shall not on that account be dismissed
but all proceedings thereon shall be stayed pending the determina-
tion of the population of the town. The court or judge shall order
a census taken of the population of the town and if the population
meets the requirements of section thirty hereof the petition shall
be proceeded upon as provided by law. Such population may be
determined as in equity causes upon a reference to a master and the
costs of the reference including his fees shall be paid as part of the
costs of election.
