Chap. 250.—An ACT to amend Chapter 406 of the Acts of Assembly of 1944,
approved April 4, 1944, by adding two new sections numbered 23-a and 23-c,
prohibiting certain sales of motor vehicles and equipment in certain counties;
and to amend and reenact Section 24 thereof providing penalties. {H 169]

Be it enacted by the General Assembly of Virginia:
1. That chapter four hundred six of the Acts of Assembly of
nineteen hundred forty-four, approved April four, nineteen hundred
forty-four, be amended by adding two new sections numbered
twenty-three-a and twenty-three-c as follows:
Section 23-a. Prohibiting sales of motor vehicle equipment
except as requested by buyer; penalties—Except upon request by
the buyer it shall be unlawful for a dealer or salesman in connec-
tion with the sale of any motor vehicle to sell any articles of equip-
ment therefor unless either (a) listed by the manufacturer as
standard equipment for such vehicle or (b) attached to such motor
vehicle as such vehicle is received from the manufacturer. Any
person violating this section shall be guilty of a misdemeanor and
upon conviction thereof shall be punished by a fine of not more
than one thousand dollars or by imprisonment for not more than
six months or by both.
Section 23-c. Counties in which preceding section applicable —
Section twenty-three-a of this act shall not apply except to sales
or deliveries and to dealers who have their place of business within
counties having a population of more than forty-one thousand three
hundred and less than forty-one thousand nine hundred persons and
an area of more than five hundred eighteen and less than five
hundred twenty-nine square miles.‘
’ 2. That section twenty-four of chapter four hundred six of the
Acts of Assembly of nineteen hundred forty-four, approved April
four, nineteen hundred forty-four, be amended and reenacted as
follows:
Section 24. Penalties—Any person violating any of the pro-
visions of this act, except those of section twenty-three-a shall be
guilty of a misdemeanor and upon conviction thereof shall be
sentenced to pay a fine of not exceeding five hundred dollars or to
undergo imprisonment for not to exceed six months, or by both
such fine and imprisonment.
