Chap. 158.—An ACT to authorize the Board of Supervisors of the county of
Roanoke to transfer to The Roanoke County Public Health Association,
Incorporated, either by gift, sale or lease, all or part of the lands, buildings
and appurtenances now used or usable by The Roanoke Coanty, Public
Health Association, Incorporated, in its operation of the Mercy House in
Roanoke County, to place certain restrictions upon such transfer, and to ex-
clude this bill from the provisions of certain named Acts. (H 301)

Be it enacted by the General Assembly of Virginia:
1. That the board of supervisors of Roanoke County is hereby
authorized and empowered to transfer in fee simple by gift or by
sale, or to make a long-term lease of, all or any portion of the lands,
buildings and appurtenances now used or usable by The Roanoke
County Public Health Association, Incorporated, in the operation
and maintenance of the institution located in Roanoke County,
known as the Mercy House. Such gift, sale or lease shall be made
to The Roanoke County Public Health Association, Incorporated,
at such time as the board of supervisors of Roanoke County may
deem best, and the board of supervisors of Roanoke County is
hereby authorized and empowered to execute the necessary instru-
ments to make the gift, sale or lease.
2. The gift, sale or lease herein authorized and empowered to
be made by the board of supervisors of Roanoke County shall
provide for the return to the board of supervisors of Roanoke
County, its successors or assignees, of any and all right, title and
interest in the aforementioned lands, buildings and appurtenances
transferred to The Roanoke County Public Health Association,
Incorporated, in the event The Roanoke County Public Health
Association, Incorporated, its successors or assignees, shall, for
any reason, discontinue or cease to operate the Mercy House as a
non-stock, non-profit corporation. Such gift, sale or lease may
further provide that The Roanoke County Public Health Associa-
tion, Incorporated, may sell any part of the aforementioned lands,
buildings and appurtenances only with the consent and approval
of the board of supervisors of Roanoke County, its successors or
assignees, and the Judge of the Circuit Court of Roanoke County.
3. The provisions of chapter three hundred seventy-one of the
Acts of Assembly of nineteen hundred thirty, as amended by
chapter three hundred twelve of the Acts of Assembly of nineteen
hundred thirty-four, are hereby declared not to apply to the lands,
buildings and appurtenances mentioned in this act, nor to any gift,
sale or lease of such property made under the terms of this act.
4. An emergency exists, this act is in force from passage.
