Chap. 15.—-An ACT to amend and reenact Section 4, as amended, of Chapter 96
of the Acts of Assembly of 1872-1873, in force February 2], 1873, which in-
corporated the town of Lebanon, in Russell County, the section relating to
powers of the council of the town. (H 48]

Be it enacted by the General Assembly of Virginia:
1. That section four, as amended, of chapter ninety-six of the
Acts of Assembly of eighteen hundred seventy-two-eighteen hundred
seventy-three, in force February twenty-one, eighteen hundred
seventy-three, be amended and reenacted as follows:
Section 4. The council shall have authority to abate or cause
to be abated, anything which, in the opinion of the council, shall be
a nuisance; to provide for the annual assessment of the taxable pro-
perty and persons of said town; to appoint and publish the place of
holding the town elections; to adopt such rules and regulations as
they may deem necessary; to prevent the running at large on the
streets and alleys of the said corporation of hogs, dogs, horses, cattle
and any and all other animals and to prevent the cumbering of
streets, sidewalks and alleys in any manner whatever; to provide
a revenue for and appropriate the same for its expenses, and said council
shall have power to provide for keeping the streets and sidewalks
in good order and paving the same; to keep the sidewalks free and
clean by the owners and occupants thereof, and to provide for other
necessary improvements, for which purpose they may levy such tax
as they may deem necessary, not in conflict with the provisions of
general law, not exceeding two dollars on the one hundred dollars,
and said council shall have power to levy a poll tax of fifty cents.
Said council shall appoint annually a sergeant; and shall fix his com-
pensation and provide for the payment of same, and prescribe his
duties and require such bond as they may deem proper; such bond
shall be payable to the said corporation. Said council shall have
power to remove said sergeant at any time they may deem proper
and appoint his successor.
The town, by and through its council, shall have the power and
authority to acquire for a public park and playground, a certain
parcel of land lying within the corporate limits of the town and
owned by Russell County Livestock & Agricultural Association,
and as a means to that end, to acquire by gift or purchase, any part,
or all, of the capital stock of said association, and to do such other
things, lawful to be done, as may be necessary to enable the town to
acquire the legal title to said parcel of land.
It shall be the duty of the sergeant to take up and impound in
a pen kept for that purpose any hog, pig, or swine found running
at large upon the streets or alleys within the limits of said corpora-
tion, and when any such hog, pig or swine shall be so taken and im-
pounded by the said sergeant he shall immediately advertise same.
at three public places for ten days, for sale to the highest bidder for
ready cash, and apply the proceeds first to the payment of the cost,
and the balance to the owner of such hog; provided, that the owner
of such hog, pig, or swine may redeem them at any time before the
sale by paying the cost incurred by penning them; the sergeant
skall charge twenty cents for penning each hog, pig, or swine, so
penned, and shall charge five cents per day for feeding each hog, pig,
or swine so penned.
2. An emergency exists and this act is in force from its passage.
