Chap. 132.—An ACT to authorize the governing body of the county of Scott
if approved in an election duly called and held in such county, to issue bonds
for the purpose of providing funds to appropriate toward the purchase or
erection of a hospital in the county of Scott. [H 280]

Be it enacted by the General Assembly of Virginia:
1. Section 1. The circuit court of the county of Scott, or the
judge thereof in vacation, upon the petition of a majority of the
board of supervisors of the county, shall make an order requiring
the judges of election at the next regular election, or at any other
time not less than thirty days from the date of such order, which
shall be designated therein, to open a poll and take the sense of the
qualified voters of the county upon the question of whether the
county shall issue bonds for the purpose of appropriating funds
toward the purchase or erection of a hospital in Scott County.
Section 2. The regular election officers of the county at the
time designated in the order authorizing the vote shall open the
polls at the various voting places in the county, and the ballots for
such election shall be prepared, distributed and voted, the election
conducted, and the result ascertained and certified in the manner
provided by law in other elections, except that there shall be
printed upon the ballots the question, “Shall the county issue bonds
to appropriate funds toward the purchase or erection of a hospital
in the county of Scott?”, and the following:

Section 3. If it shall appear by the report of the commissioners
of election that a majority of the qualified voters of the county
voting on the question approve issuing the bonds for such project,
the circuit court shall forthwith enter an order authorizing the
governing body of the county to proceed to carry out the wishes
of the voters. The governing body of the county, upon such pro-
ceedings being had and not otherwise, shall thereupon have, with
reference to issuing the bonds for such project so approved, the
power, and it is hereby authorized to issue its negotiable bonds
for the purpose of providing funds to appropriate toward the
purchase or erection of a hospital in the county. Such bonds shall
be authorized by resolution of the governing body and shall be
issued in one or more series, shall bear such date or dates, mature
at such time or times, not exceeding thirty years from their respec-
tive dates, bearing interest at such rate or rates, not exceeding six
per centum per annum, payable at such time, be in such denomina-
tion, be in such form, either coupon or registered, carry such regis-
tration privileges, be executed in such manner, be payable in such
medium of payments, at such place or places and be subject to such
terms of redemption, with or without premium, as such resolution
or subsequent resolutions may provide. The bonds may be sold at
public or private sale for. such price or prices, as the governing body
may determine, provided that the interest cost to maturity of the
money received for any issue of bonds shall not exceed six per
centum per annum. Such bonds shall become an obligation of the
county; but such bonds shall not be issued for any sum in excess
of two hundred fifty thousand dollars; and if the governing body
of the county shall issue any bonds pursuant to this act the board
of supervisors shall thereafter, and is hereby authorized and
empowered, and it shall be their duty, to provide for the imposi-
tion and collection annually of a tax in addition to all other taxes
on property subject to local taxation and not exempt from the
levy of taxes, sufficient in amount to pay the interest on such bonds
and the principal thereof, as the same respectively become due,
notwithstanding any tax rate limitations that would otherwise be
applicable to the levy of such taxes, and such tax shall be levied
and collected by the same officers, at the same time and in the
same common manner as general taxes of the county.
Section 4. Funds derived from the issuance and sale of bonds
hereunder may be contributed by the governing body to any non-
profit corporation or association organized for the purpose of
acquiring sites for, establishing or erecting, such hospital in the
county of Scott.
2. Anemergency exists and this act is in force from its passage.
