Chap. 99.—An ACT to authorize the State Highway Commission to improve
certain private roads and certain town streets and roads upon certain terms and
under certain circumstances. [S B 57]

Be it enacted by the General Assembly of Virginia:
1. Section 1. The State Highway Commission may, upon the re-
quest of the board of supervisors of any county and at the expense of the
owner of the land, improve private roads giving direct access from the
home or other central buildings on the property along the shortest prac-
tical route to the nearest public highway, and upon the request of the
council of any town having a population less than fifteen hundred in-
habitants according to the last preceding United States census, and at
the expense of said town, improve and maintain any streets or roads there-
in not in the State highway system. The work, if done by the Commis-
sion, shall only be done with its own equipment and employees. The
Commission shall in no case undertake any such work until certification
is made by the board of supervisors that the property owner cannot se-
cure the services of a private contractor to perform the work nor then
until the owner has deppsited with it a certified check in the amount
estimated by the Commission as the cost of the work; provided that not
more than one thousand dollars shall be expended on any one such private
project in any one year, and provided further that as to streets and roads
in towns aforesaid, no certification by the board of supervisors or deposit
shall be necessary. No work of ordinary maintenance shall be done on
any such private road under the provisions of this act.
Section 2. The Commission shall not improve any such road under
the provisions of this act until the Governor authorizes the Commission
to proceed with such work.
