Chap. 382.—An ACT to amend Chapter 141 of the Acts of Assembly of 1906, ap-
proved March 10, 1906, as amended, which provided a charter for the Town of
Cambria, by adding five new sections numbered 24-a through 24-e, so as to
authorize the town to acquire, or construct, operate and maintain, a town water
supply system and sewage disposal plant and system, to exercise certain powers
in relation thereto both within and without the town, to apply for, obtain and
expend grants, to issue certain bonds; to provide for certain elections ; and to
provide for charges for use of any system established. (H B 425]

Be it enacted by the General Assembly of Virginia:
1. That chapter one hundred forty-one of the Acts of Assembly of
nineteen hundred six, approved March ten, nineteen hundred six, as
amended, be further amended by adding five new sections numbered
twenty-four-a through twenty-four-e, as follows:
Section 24-a. Whereas the Town of Cambria, Montgomery County,
Virginia, contemplates the construction of a sewage disposal system and
a water system, either or both, in the near future, and it is apparent that
such improvement or improvements are necessary and the Town of
Cambria, Virginia, is hereby empowered to acquire, by purchase or con-
demnation, any spring or springs suitable for the town water system,
whether the same lie within or without the corporate limits of the said
town, and to acquire the same from any individual, firm, or corporation,
either by purchase or condemnation, and to secure the proper right of
ways for the pipe or conduit lines over and through the land or lands of
individuals, firms, or corporations, and to acquire a proper site or sites for
the erection and construction of reservoir or reservoirs, and also to do
what is necessary to maintain, construct, and operate the same and to con-
struct a sewage disposal system and to acquire sites for a sewage disposal
plant, either by purchase or condemnation, and to acquire the right of
ways and necessary sites for the construction and operation and mainten-
ance of sewage disposal system within or without the corporate limits of
the Town of Cambria, Virginia, and to acquire the necessary real estate
and right of ways from any firm, person, or corporation for the construc-
tion, operation and maintenance of said sewage system.
Section 24-b. That the Town of Cambria, Virginia, is hereby em-
powered to apply to any of the lending agencies of the United States of
America to apply for a grant to aid in the construction of either a sewage
disposal system or a water system in the Town of Cambria, Virginia.
Section 24-c. The Town of Cambria shall have the following pow-
ers and duties with respect thereto:
(a) To fix and prescribe for the rates of charge for the connections
with and for the use of the sewage system and may fix different rate for
any services or sewage connection without the Town of Cambria, Vir-
ginia, and to fix a monthly minimum charge for each residence and an
additional charge for more than one family residing in a said residence
and for an apartment house, fix a rate and apportionate charge to each
apartment therein occupied, and may fix a rate as to business houses in
an equitable and fair manner and to fix a minimum monthly charge for
every such connection and to make the charges for the use of such sew-
age system and lien on the real estate served by any individual, firm, or
corporation.
(b) To fix and prescribe the rates for the charge for the connections
and use for the water and to fix a minimum monthly rental and to fix a
rate per one thousand (1,000) gallons used for every residence, apart-
ment house, business establishment within the Town of Cambria, and
to fix a separate or higher rate for each resident, apartment, or business
house furnished with water without the corporate limits of the Town of
Cambria.
(c) To empléy and fix the compensation of any technical, clerical,
or other assistants which from time to time may be necessary in the op-
eration and maintenance of either the sewage disposal system or water
system.
(d) All moneys derived from connection charges with the use of
either the sewage disposal system or water system shall be applied by the
officers of the Town of Cambria to the operation, maintenance, thereof and
to the construction of such additions thereto or extensions thereof as may
be necessary.
(e) The sewage disposal project shall be separate and apart from
any other project, and shall be voted on by the qualified voters of the
town separately.
(f{) The water system shall be separate from the sewage disposal
system or any other project and shall be voted on by the qualified voters
of the Town of Cambria, Virginia, separately.
Section 24-d. That before entering into a contract for either of the
projects designated as a sewage disposal project, or the project known
as the water system project, the same shall be submitted to the qualified
voters of the Town of Cambria, Virginia, in an election to be held as
now provided by the statute of Virginia in such cases may be provided.
Section 24-e. The Town of Cambria is hereby empowered, in the
event the qualified voters of the Town of Cambria, Virginia, vote in favor
of either project, to issue revenue bonds for the construction of the sew-
age disposal system and to issue bonds for the water system, the said
bonds to be issued separately and the said bonds to be either registered
or unregistered bonds and the same to be sold either publicly or privately
at not less than par, and to bear interest at the rate of not greater than
six per centum per annum and the Town of Cambria is hereby authorized
to establish a sinking fund for the purpose of retiring said bonds and the
interest thereon as the same falls due. The council of the said town may
annually invest in bonds of the United States, State of Virginia, or any
municipal corporation, to be used as the said sinking fund such appropria-
tion of the revenue of the said town as shall be necessary to pay the said
bonds before maturity which sinking fund shall be used exclusively for
the payment of said bonds and that the said bonds shall not be payable
more than fifty years after date and the annual installments and principal
thereof to be in such amount as to make the aggregate annual payments
of principal and interest substantial and equal throughout the life of the
said bonds and the said town shall have the power to redeem the said
bonds at or on any said interest after the expiration of five years from
the date of issue. Said bonds are, whether registered or unregistered,
serial or coupon bonds, numbered, signed by the mayor, the treasurer of
said town, and recorded in the book kept for that purpose.
Before submitting either the sewage disposal project or the water
system project to the qualified voters of the Town of Cambria, Virginia,
in a duly called election, the Town council shall have made a survey as
to the cost of the sewage disposal system by qualified engineer or en-
gineers and the water project will also have a survey made by a qualified
engineer or engineers as to the cost at least fifteen days prior to the date
of the election, post the approximate cost of each project, before either or
both of the projects are voted on, at the front door of:-the Town Hall in
the Town of Cambria, Virginia, and publish the cost of each project for
at least two successive weeks in a newspaper having general circulation
in the Town of Cambria, Virginia, before the projects, or either project
is voted upon.
2. An emergency exists and this act is in force from its passage.
