Chap. 346.—An ACT to amend and re-enact Section 30 of Chapter 481 of the
Acts of Assembly of 1942, approved April 7, 1942, which provided a new
charter for the City of Fredericksburg, the section relating to the civil and
lice justice of the city, his qualifications, duties, powers, compensation and
Jurisdiction. ° [H B 417]

Be it enacted by the General Assembly of Virginia:
1. That section thirty of chapter four hundred eighty-one of the
Acts of Assembly of nineteen hundred forty-two, approved April seven,
nineteen hundred forty-two, be amended and re-enacted, as follows:
Section 30. There shall be elected by the qualified voters of the City
of Fredericksburg, Virginia, on the Tuesday after the first Monday in
November, nineteen hundred forty-five, and every four years thereafter,
a special justice of the peace, to be known as the civil and police justice,
who shall hold office for a term of four years, and until his successor
is elected and qualified, and° whose term of office shall begin on the
first day of January succeeding his election.
The city council shall elect a substitute civil and police justice and
clerk of said court, and if the office of justice of the civil and police justice
court of Fredericksburg, Virginia, becomes vacant by death or resigna-
tion, or for any other cause, the city council shall immediately elect a
justice of the civil and police justice court to serve as such during the
unexpired term.
The civil and police justice of said city, the substitute justice and the
clerk of said court shall ex-officio be the justice, substitute justice and the
clerk of the juvenile and domestic relations court for said city and their
terms of office shall be concurrent and co-extensive with their terms as
justice, substitute justice and clerk of the civil and police justice court.
Unless otherwise provided by charter, the civil and police justice,
elected and appointed hereunder, the substitute civil and police justice
and the clerk of said court shall have the qualifications, jurisdiction,
powers and duties now or hereafter conferred or imposed upon civil and
police justices, substitute civil and police justices and the clerk of said
court under the provisions of chapter one hundred twenty-four of the
Code of Virginia, and any amendments thereto.
The salaries of the justice, the substitute justice and the clerk of the
civil and police justice court and the juvenile and domestic relations court
shall be fixed by the city council.
In any case involving the legality or validity of any ordinance of
the City of Fredericksburg, the city shall have the right of appeal to the
circuit court of the city from any judgment or decision of the civil and
police justice court. -
All fines and forfeitures for the violation of city ordinances, and all
fees and costs arising therefrom, together with all fines and costs from
violation of State laws, except that required by general law to be other-
wise paid, and all fees in civil cases shall be collected by the clerk of the
civil and police justice and juvenile and domestic relations courts, as the
case may be, who shall pay all money due the city monthly to the city col-
lector and the State fines and costs shall be paid as prescribed by law.
The clerk of said courts shall keep such books and records as shall be
prescribed by the city council.
