Be it enacted by the General Assembly of Virginia:
1. That section six hundred forty-nine, as amended, of the Code of
Virginia, be amended and re-enacted, as follows:
Section 649. No one shall be eligible for appointment as division
superintendent unless he meets the minimum qualifications set up by the
State Board of Education, and in order that an applicant for the position
of division superintendent may know what qualifications are required of
him, the State Board of Education is hereby required to publish on the
first of February of the year in which such election is to take place, a
statement showing the minimum qualification for the position of division
superintendent of schools, which statement shall be furnished to all ap-
plicants. The superintendents at present in office shall continue therein
until their present terms expire.
Within sixty days before May first, nineteen hundred thirty-three
and every four years thereafter there shall be appointed by the school
board or boards of each school division, one division superintendent of
schools who shall be selected from a list of eligibles certified by the State
Board of Education and shall hold office for four years. Upon receipt
of a request from a county or city school board made to the State Board
of Education on or before March one of the year of the appointment, the
State Board shall thereupon certify to the county or city board or boards
a list of not less than five nor more than ten names selected from the
eligible list of division superintendents. If none of the eligibles so certi-
fied is acceptable to the county or city board or boards, the State Board
shall upon proper notice supply the county or city board or boards with
one or more additional lists of from five to ten certified eligibles from
which additional list or lists the superintendent shall be selected. The
salary and conditions of appointment shall conform to section six hun-
dred and fifteen. Any vacancy in the office of division superintendent
shall be filled by the school board or boards of the divisions. In the
event that the local school board fails to elect a division superintendent
within the time prescribed by this section, the State Board of Education
shall appoint such division superintendent.
When a school division is composed of a city and one or more coun-
ties, or two or more counties, the school boards composing the division
must meet jointly and a majority vote of the members present shall be
required to elect a superintendent.
