Chap. 238.—An ACT to amend and re-enact Section 5229-a of the Code of Vir-
ginia relating to certain wills. [S B 204]

Be it enacted by the General Assembly of Virginia:
1. That section fifty-two hundred twenty-nine-a of the Code of
Virginia be amended and re-enacted, as follows:
Section 5229-a. Presumption of formal execution of wills made
by persons in military service—A testamentary paper executed before
or after October one, nineteen hundred forty by a person in the military
service of the United States as defined by the Soldiers’ and Sailors’ Re-
lief Act of nineteen hundred forty, as now in force or hereafter amended,
while in such service, purporting on its face to be witnessed as required
by section fifty-two hundred twenty-nine of the Code of Virginia, upon
proof of the signature of the testator by any two disinterested witnesses,
shall be presumed, in the absence of evidence to the contrary, to have been
executed in accordance with the requirements of that section and shall
be admited to probate in like manner and with like effect as 1f the for-
malities of execution were duly and regularly proved.
