“Chap. 179.—An ACT to amend and re-enact Chapter 142 of the Acts of Assembly
of 1922, approved March 9, 1922, which provided for appointment of an as-
sistant attorney for the Commonwealth for the City of Norfolk, so as to au-
thorize appointment, by the attorney for the Commonwealth of such city, of an
additional assistant attorney for the Commonwealth, and to prescribe his power,
duties, functions and compensation. [S B 38]

Be it enacted by the General Assembly of Virginia:
1. That chapter one hundred forty-two of the Acts of Assembly
i nineteen hundred twenty-two, approved March nine, nineteen hun-
red twenty-two, be amended and re-enacted, as follows:
Section 1. There shall be an assistant attorney for the Common-
vealth for the City of Norfolk, Virginia, who shall be a resident citizen
f said city, and shall have been admitted to practice in the courts of the
‘ommonwealth. He shall be appointed by the attorney for the Com-
nonwealth for the City of Norfolk, to serve at the pleasure of the attor-
ney for the Commonwealth, and shall qualify in the manner prescribed by
law for the attorney for the Commonwealth.
He shall, so far as required by the attorney for the Commonwealth
for the City of Norfolk, discharge and perform any of the duties now and
hereafter imposed by law upon such attorney for the Commonwealth, and
in the discharge of such duties, shall be under the direction and control
of such attorney for the Commonwealth.
He shall receive such compensation as may be fixed by such attor-
ney for the Commonwealth for the City of Norfolk, and is to be paid out
of the expenses allowed to such attorney for the Commonwealth, pursuant
to law.
Section 2. The attorney for the Commonwealth for the City of
Norfolk is also authorized and empowered to appoint an additional as-
sistant attorney for the Commonwealth for the City of Norfolk, Virginia,
when the Judge of the Corporation Court of the City of Norfolk shall
certify, by order duly entered of record, that the necessity therefor ex-
ists.
The additional assistant attorney for the Commonwealth for the City
of Norfolk shall also be a resident citizen of such city, and shall have been
admitted to practice in the courts of the Commonwealth. He shall serve
at the pleasure of such attorney for the Commonwealth, and shall qualify
in the manner prescribed by law for such attorney for the Common-
wealth.
He shall, so far as required by the attorney for the Commonwealth
for the City of Norfolk, discharge and perform any of the duties now
and hereafter imposed by law upon such attorney for the Commonwealth,
and in the discharge of such duties, shall be under the direction and con-
trol of such attorney for the Commonwealth.
He shall receive such compensation as may be fixed by the attorney
for the Commonwealth for the City of Norfolk, and is to be paid out of

2. An emergency exists and this act is in force from its passage.
