Chap. 132.—An ACT to amend the Code of Virginia by adding a new section
numbered 2772-a authorizing the governing bodies of counties to acquire land
for the dumping of waste material and to prohibit the dumping of such ma-
terial elsewhere without the written consent of landowner and providing pen-
alties. [S B 59]

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding a new section
numbered twenty-seven hundred seventy-two-a, as follows:
Section 2772-a. (a) Dumps for waste material, et cetera, acquisi-
tion of, by governing bodies of counties.—The governing bodies of coun-
ties are authorized in their discretion to acquire by lease, gift, purchase
or condemnation land in each or any respective magisterial district for the
purpose of providing a dumping place for waste material including
abandoned automobiles. The area in any magisterial district is limited to
three acres and no waste material shall be deposited in any such dump of
a liquid or fluid character. No deleterious substance, which might be or
become a nuisance to adjoining property, shall be deposited on such
dumps nor any waste material from manufacturing or industrial plants
The governing bodies of counties are vested with the power of eminent
domain insofar as the exercise of such power 1s necessary for the acquisi-
tion of lands for the purposes of this section, and in the exercise of such
power are vested with such powers and rights as are or which may here-
after be vested by law in the governing bodies of counties and the pro-
cedure in such condemnation suit or procedure shall be under the restric-
tions provided by the general statutes of this State relative to the con-
demnation of land so far as the same may be applicable and are not in
conflict with the provisions of this section.
(b) Penalties.—In any county or any magisterial district thereof in
which a dump for waste material has been established as described above,
it shall be unlawful to dump any such waste material including aban-
doned automobiles except with the written consent of the owner of the
land. Any person dumping any waste material including abandoned
automobiles, except on public dumps or with the written consent of the
landowner, in any county adopting the provisions of this section shall be
guilty of a ‘misdemeanor and punished accordingly.
