Chap. 383.—An ACT for the relief of George P. Browning et als. [S 122]

Whereas, The State Highway Commission, before constructing the
public road known as State route number three (now route number five
hundred twenty-two), and Project number seven hundred ninety-two-D.
between Massies Corner and Chester Gap, made two (2) location sur-
veys, one through the town of Flint Hill and one around the town; and.
Whereas, The cost of the necessary rights of way on the location
through the town was approximately five thousand dollars ($5,000.00)
greater than such cost would have been on the location around the town:
and,
Whereas, The citizens of the town were desirous of having the road
located and constructed through the town, and appointed a committee
to work and act for that purpose ; and,
Whereas, The committee had a meeting with the property owners
along the location through the town, a majority of whom agreed to
donate to the Commonwealth of Virginia sufficient of their lands for the
construction through the town: and,
Whereas, Acting upon this situation, the committee, George P.
Browning, Mabel Browning, Frank H. Carey, H. S. Barksdale, Lucy
Barksdale, F. D. Dennis, C. C. Hellen and Mary Hellen, guaranteed
to the State Highway Department payment of the cost of the rights of
way through the town in excess of the cost, as estimated, of the rights
of way on the location around the town; and,
Whereas, Pursuant to the aforesaid action by the committee, the Stare
Highway Department proceeded to construct the said road on the locatior
through the town; and,
Whereas, Some of the agreements were incorrectly dated, which had
the effect of shortening the term or duration thereof, certain property
owners declined to abide by the provisions thereof and it became neces.
sary for the State Highway Commissioner to condemn in such cases ; and.
‘Whereas, The committee being of the opinion that the error in dating
the said agreements was made by a representative of the State Highway
Department ; now, therefore :
Be it enacted by the General Assembly of Virginia :
1. That there be, and is hereby, appropriated to be paid to the said
committee out of any money appropriated to the State Highway Com.
mission for the construction and maintenance of highways, the sum of
three thousand one hundred and seventy-five dollars ($3,175.00), tc
reimburse the said committee in the total amount of the awards in the
said condemnation proceedings against Mrs. James M. Settle and Mr.
and Mrs. M. R. Bradford, the same to be paid by the Treasurer of Vir-
ginia, on warrant of the Comptroller of Virginia.
