Chap. 311.—An ACT to amend Article 2 of an act entitled “An Act to incorporate
the town of Phoebus, in Elizabeth City County.”, approved January 22, 1900,
by adding a new section numbered 2-a, making certain provisions concerning
the jurisdiction and salary of the mayor; the compensation of the recorder ; the
duties and bond of the treasurer; and the compensation of the sergeant; and
providing for the employment of a delinquent tax collector. {H 396]

Be it enacted by the General Assembly of Virginia:
1. That ARTICLE II of an act entitled “An Act to incorporate
the town of Phoebus, in Elizabeth City County.”, approved January
twenty-two, nineteen hundred, be amended by adding a new section
numbered two-a, as follows:
ARTICLE II
Section 2-a. Notwithstanding any provisions of the preceding sec-
tion to the contrary: (a) the mayor shall have exclusive original juris-
diction of all cases involving violations of town ordinances, and none
other ; and he shall receive such salary as the council may deem proper,
not exceeding eighteen hundred dollars a year, which shall be in full for
all services rendered by him; (b) The recorder shall receive for his
services such compensation as the council may deem proper, not ex-
ceeding one hundred twenty-five dollars a month; (c) the treasurer
shall, in addition to the other duties required of him by the preceding
section or by general law, make to the council monthly, and at such
other time as it may require, statements and accounts of fund deposits
and withdrawals, bond sales and purchases and their redemption, and
interest payments on bonds and deposits, and shall invest the reserve
funds, with the advice and approval of the council; and shall carry out
all his other duties, including the collecting of taxes, licenses and other
monies due the town, under rules, regulations and ordinances adopted
and enacted by the council. Before entering upon the duties of his
office, he shall give bond as provided in the preceding section, except
that the penalty of the bond shall be ten thousand dollars instead of five
thousand dollars as therein provided; (d) the sergeant shall receive
as full compensation for all his services, such salary as may be prescribed
by the council, not exceeding two hundred dollars a month.
The council shall have authority to employ a delinquent tax collector
to collect town taxes not collected by the treasurer within three years
after they are returned delinquent, upon such terms as may be agreed
upon, and may require of him such bond as the council deems proper.
He shall have the same powers and authority as the treasurer, for the
collection of the delinquent taxes turned over to him, and shall pay over
all money collected by him thereon, less his compensation and any costs
and expenses incurred in making the collection, to the treasurer who
shall handle same as other tax funds are handled by him, but shall re-
ceive no commissions thereon.
