Chap. 290.—An ACT to repeal Sections 3616, 3617, 3628, 3629, 3632 and 3641 of
the Code of Virginia, relating to pilots and piloting; and to amend the Code
of Virginia by adding in Chapter 142, two new sections numbered 3616 and 3617,
relating to pilots and piloting; and to amend and re-enact Sections 3631 and
3645 of the Code of Virginia, relating to the same subject. {H 311]

Be it enacted by the General Assembly of Virginia:
1. That sections thirty-six hundred sixteen, thirty-six hundred
seventeen, thirty-six hundred twenty-eight, thirty-six hundred twenty-
nine, thirty-six hundred thirty-two and thirty-six hundred forty-one of
the Code of Virginia relating to pilots and piloting are repealed.
2. That the Code of Virginia be amended by adding in chapter one
hundred forty-two, two new sections numbered thirty-six hundred six-
teen and thirty-six hundred seventeen, and that sections thirty-six hun-
dred thirty-one and thirty six hundred forty-five of the Code of Virginia,
be amended and re-enacted, as follows:
Section 3616. Any apprentice to a state branch pilot may apply to
the Board of Commissioners for a certificate as a limited branch pilot.
The Board may grant him such certificate after proper examination if
in the opinion of the Board the applicant be qualified. The Board may
cause to be written on the certificate such limitation of draft or tonnage
as deemed proper and such limited branch pilot shall perform his duties
of piloting and conducting vessels within the limitation imposed by his
certificate. All certificates shall expire on December thirty-one of the
year in which issued.
Section 3617. Pilots who have qualified and been licensed in ac-
cordance with the provisions of section thirty-six hundred fifteen of the
Code shall be designated as branch pilots and may pilot and conduct
vessels of every burthen and description.
Pilots who have qualified and been licensed in accordance with the
provisions of section thirty-six hundred sixteen of the Code shall be
designated as limited branch pilots and may pilot and conduct vessels
subject to the limitation imposed by their certificates.
Section 3631. Pay for detention on sea-going vessel —If a pilot
be detained on board any sea-going vessel he shall be paid in accordance
with the rate prescribed for a day’s detention by the State Corporation
Commission for each day he is so detained, to be paid by the master,
owner, or consignee of such vessel. If any such pilot be carried beyond
the limits of his State against his will, he shall be entitled to recover the
sum of three hundred dollars from the master or owner of the vessel
upon which he has been carried away. Every vessel having a branch
pilot, and arriving at the pilot station, shall remain there fifteen hours,
if required, to give the pilot an opportunity to be taken off, and for failing
so to do shall forfeit to him fifty dollars.
Section 3645. When pilot to convey vessel into quarantine ——Any
pilot first meeting a vessel coming from sea shall inquire into the health
of her crew and the place from which she last came; and if she has a
dangerous, contagious or infectious disease on board, or comes from any
place from which vessels coming are required to perform quarantine
in this State, or from any port thereof, he shall direct the vessel to follow
his boat, and carefully conduct her to the nearest place appointed for
vessels to quarantine, and, as soon as possible, give notice thereof to the
health officer of the port nearest thereto; and if any pilot be permitted
to go on board a vessel without being informed of a contagious or in-
fectious disease on board, and be obliged to remain on board, or per-
form quarantine in consequence thereof he shall be paid for each day’s
detention in accordance with the rate prescribed for a day’s detention by
the State Corporation Commission.
2. An emergency exists and this act shall be in force from its pass-
age.
