Chap. 282.—An ACT to amend and re-enact Section 935 of the Code of Virginia,
as amended, relating to the Board of Visitors of the College of William and
Mary in Virginia. [H 151]

Be it enacted by the General Assembly of Virginia:
1. That section nine hundred thirty-five of the Code of Virginia,
as amended, be amended and re-enacted, as follows:
Section 935. Board of Visitors; Number; Appointment; Terms;
Duties.—(a) The Board of Visitors is to consist of ten visitors to be
appointed by the Governor, from the State at large, and the Superin-
tendent of Public Instruction ex-officio. The visitors in office when this
amendment takes effect are continued until January one, nineteen hun-
dred forty-five. Their successors are to be appointed for the following
terms: two for terms to expire five years; two for terms to expire four
years; two for terms to expire three years; two for terms to expire
two years ; and two for terms to expire one year, from December thirty-
one, nineteen hundred forty-four.
(b) Thereafter, within sixty days preceding the day on which the
terms of office respectively of the visitors will expire by limitation, the
Governor shall appoint, to fill the vacancies so occasioned, qualified per-
sons whose terms shall be for five years from the day on which the terms
of their immediate predecessors expired.
(c) All vacancies, whether occasioned by failure to make an ap-
pointment within the sixty days preceding any regular expiration as
required, or otherwise, are to be filled by the Governor for the unexpired
term.
(d) All appointments are subject to confirmation by the Senate at
its next session. Visitors shall continue to discharge their duties after
their terms have expired until their successors have been appointed and
have qualified.
(e) The Governor may appoint visitors from a list of qualified per-
sons submitted to him, before or after induction into office, by The
Alumni Association of the College of William and Mary in Virginia,
on or before the first day of October of any year in which the terms of
any visitors will expire.
(f) Whenever a vacancy occurs, otherwise than by expiration of
term, the Governor shall certify this fact to the association and nomi-
nations may be submitted of qualified persons and the Governor may fill
the vacancy, if his discretion so dictates, from among the eligible nominees
of the association, whether or not alumni or alumnae.
(g) Every list shall contain at least three names for each vacancy
to be filled.
(h) The Governor is not to be limited in his appointments to the
persons so nominated.
(1) Atnotime shall less than six of the visitors be alumni or alumnae
of the College.
(j) No person shall be eligible to serve for or during more than
two successive terms, and incumbency during the current term when
this amendment takes effect constitutes the first of the two successive
terms with respect tc eligibility for appointment, except that members
who shall have served for less than four years on January first, nineteen
hundred forty-five, snall be eligible for re-appointment for such periods
as shall make a total continuous service of ten years.
(k) The Board shall control and expend the funds of the College
and any appropriation hereafter provided, and shall make all needful
rules and regulations concerning the College, appoint the president and
all professors, teachers and agents, and fix their salaries, and generally
direct the affairs of the College.
