Chap. 275.—An ACT to amend the Code of Virginia by adding thereto a new
section numbered 3042-a, authorizing counties, cities and towns having the
right of eminent domain to exercise the right of condemnation in the same man-
ner as is prescribed by law for condemnation proceedings instituted by the State
Highway Commission. [S 110]

Be it enacted by the General Assembly of Virginia :
1. That the Code of Virginia be amended by adding thereto a new
section numbered thirty hundred forty-two-a, as follows:
Section 3042-a. Condemnation proceedings by counties, cities and
towns; how conducted.—Proceedings for the acquisition of property by
counties, cities and towns in all cases in which they now have or may
hereafter be given the right of eminent domain, may be instituted and
conducted in the name of such county, city or town, and the procedure
shall be mutatis mutandis the same as is prescribed in section two, as
amended, of chapter three hundred eighty of the Acts of the General
Assembly of nineteen hundred forty, approved April one, nineteen hun-
dred forty, as amended, for condemnation proceedings by the State
Highway Commission in the construction, reconstruction, alteration.
maintenance and repair of the public highways of the State.
If the property sought to be condemned is situated in a city the pro-
cedure shall be by petition to the circuit court of the city, or any other
city court of record having jurisdiction of condemnation proceedings, or
to the judge of any such court in vacation.
