Chap. 214.—An ACT to amend the Code of Virginia by adding thereto a new
section numbered 5827-b, prescribing a period after which certain deeds of trust
and mortgages and liens reserved to secure unpaid purchase money shall not
be enforced. [H 282]

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding thereto a new
section numbered fifty-eight hundred twenty-seven-b, as follows :
Section 5827-b. Limitation of enforcement of deeds of trust and
mortgages and liens to secure unpaid purchase money when no maturity
date of debt is given.—No deed of trust or mortgage heretofore or here-
aiter given to secure the payment of money, and no lien heretofore or
hereafter reserved to secure the payment of unpaid purchase money, in
which no date is fixed for the maturity of the debt secured by such deed
of trust, mortgage, or lien, shall be enforced after twenty vears from the
date of the deed of trust, mortgage, or other lien; provided that the period
of one year from the death of any party in interest shall be excluded from
the computation of time, and provided further that the limitation may be
extended by an endorsement within the twenty vear period upon the
margin of the page of the deed book on which the instrument is recorded
in the manner set forth in section fifty-eight hundred twenty-seven of
the Code.
2. This act shall be in force and effect on and after January one,
nineteen hundred forty-six. ;
