Chap. 165.—An ACT for the relief of the heirs of Mary Riddick. [H 73}

Whereas, during her life time, Mary Riddick surrendered to the
Commonwealth of Virginia, public bond number seventy-two hundred
seven, and on the first day of July eighteen hundred seventy-one, re-
ceived part payment in cash and the balance evidenced by Virginia De-
ferred Certificate number twenty-two hundred seventy-six (2276) in
the principal sum of one thousand eighty-six dollars sixteen cents
($1086.16), with accrued interest in the amount of three thousand two
hundred fifty-eight dollars fifty cents ($3258.50), which certificate was
issued pursuant to Chapter two hundred eighty-two of the Acts of As-
sembly of eighteen hundred seventy-one providing for the funding and
payment of the Public Debt, and was registered in her name and owned
by her at the time of her death; and ,
Whereas, the certificate with interest thereon was to be paid in ac-
cordance with the settlement to be made between the States of Virginia
and West Virginia in regard to the Public Debt of the State of Virginia
at the time of its dismemberment ; and
Whereas, under the subsequent settlement between these two States
it was determined that the certificate, if presented for payment prior
to January first, nineteen hundred thirty-nine, would have a cash value
of one thousand five hundred forty dollars seventy cents, ($1540.70),
but, if not so presented for payment by that date, would be presumed
to have been lost or destroyed and therefore cancelled ; and
Whereas, Mary Riddick did not so present the certificate for pay-
ment prior to January first, nineteen hundred thirty-nine, for the reason
that it was temporarily misplaced and not discovered by her until a few
days thereafter ; and
Whereas, although the certificate is not a legal obligation of the State
of Virginia, and therefore not collectible, it is deemed proper that the
heirs of Mary Riddick be reimbursed an amount equal to the value such
certificate would have had if it had been presented for payment prior
to January first, nineteen hundred thirty-nine ; now, therefore
Be it enacted by the General Assembly of Virginia:
1. That the Comptroller be, and he is hereby, directed to draw a
warrant on the State Treasurer for one thousand five hundred forty dol-
lars seventy cents ($1540.70), payable to Robert W. Withers, N. R.
Withers, Melville E. Withers, Mary Carr Withers and Anna Withers
Rollings, who are all of the heirs at law and direct descendants of Mary
Riddick, to be delivered by the State Treasurer to these heirs upon the
surrender of the certificate. For the purpose of this act there is hereby
appropriated out of the general fund of the State treasury the sum of
one thousand, five hundred forty dollars seventy cents ($1540.70).
