Chap. 133.—An ACT to amend and re-enact Section 1006 of the Code of Virginia,
as amended, relating to the State Hospital Board and certain of its powers and
duties, so as to make certain changes in the per diem expenses of members.

Be it enacted by the General Assembly of Virginia:
1. That section one thousand six of the Code of Virginia, as amended,
be amended and re-enacted, as follows:
Section 1006. (a) For the supervision, management and control of
the several State institutions mentioned in section one thousand and five,
and such other similar institutions as may hereafter be established, all of
which institutions, whether heretofore or hereafter established, are here-
inafter referred to as State hospitals, there shall be a single board of
directors, to be known and referred to as the State Hospital Board,
hereinafter sometimes called the “Board”. The Board shall consist of
seven members to be appointed by the Governor, subject to confirmation
by the General Assembly, if in session when such appointment 1s made,
and if not in session, then at its next succeeding session. One member
of the Board shall be appointed for a term of one year, two for a term
of two years each, two for a term of three years each, and two for a
term of four years each; subsequent appointments shall be for a term of
four years each, except appointments to fill vacancies, which shall be
for the unexpired terms. Members of the Board may be suspended or
removed by the Governor at his pleasure. Vacancies in the membership
of the Board shall be filled by the Governor subject to confirmation by
the General Assembly as hereinabove provided.
(b) The Board shall select one of its members as chairman who
shall receive no additional compensation as such. It shall also appoint
its secretary, who shall not be a member of the Board, and fix his com-
pensation, provided that if the Commissioner of Mental Hygiene and
Hospitals be appointed as secretary he shall receive no additional com-
pensation therefor. The sectetary shall perform the duties required
of him by the Board.
(c) The Board shall maintain an office in the city of Richmond where
all records of the Board shall be kept, except such as it finds necessary
to be kept at the respective State hospitals.
(d) The Commissioner of Mental Hygiene and Hospitals shall be
the chief executive officer of the State Hospital Board, and shall perform
such duties and exercise such powers as are imposed or conferred upon
him by the State Hospital Board by general rule or special order, within
the limitations of the Board’s legal powers.
(e) The Board shall meet quarterly in the city of Richmond, and
at such other times and places as it deems proper. Four members shall
constitute a quorum. The Board shall visit or inspect the several hos-
pitals and colonies under its supervision and control at least once each
year. The members of the State Hospital Board shall receive no salaries,
but shall be paid their necessary traveling and other expenses incurred
in attendance upon meetings, or while otherwise engaged in the dis-
charge of their duties, and the sum of ten dollars a day for each day or
portion thereof in which they are engaged in the performance of their
duties, provided that such per diem shall not exceed six hundred dollars
a vear for each member.
(f) The compensation and expenses hereinbefore authorized to be
paid to the members of the Board, the secretary and its chief executive
officer shall be paid by the State Treasurer, out of funds appropriated
to the Board, and the several hospitals and colonies under its super-
vision, on warrants of the Comptroller issued upon vouchers signed by
the chairman of the Board or by such other person or persons as desig-
nated by it for such purpose.
(g) The Board, in addition to other powers, functions and duties
elsewhere conferred and imposed upon it, shall have full supervision.
management and control of the State hospitals. All the rights, powers
and duties vested in and conferred and imposed upon special boards of
directors of the State hospitals and the general board of directors thereof
by law are hereby transferred to, vested in, and conferred and imposed
upon the State Hospital Board herein provided for: provided that the
Board may in its discretion in respect to any one or more of the State
hospitals. from time to time designate one or more of its members to
exercise the rights and powers, and to perform the duties, vested in and
conferred and imposed upon special boards of directors of the State
hospitals by an act of the General Assembly of Virginia, entitled “An
act to provide for the sexual sterilization of inmates of State institutions
in certain cases.”, approved March twentieth, nineteen hundred twenty-
four, and in such event all the rights, powers, and duties vested in and
conferred and imposed upon the special boards of directors of the State
hospitals by the act shall be transferred to, vested in, and conferred and
imposed upon the member or members so designated by the State Hos-
pital Board.
(h) No member of the Board shall be eligible to any other position
in any State hospital during the term for which he is appointed, or for
twelve months thereafter.
