Chap. 109.—An ACT to amend the Code of Virginia by adding a new section num-
bered 2769, relating to compensation and mileage of members of boards of super-
visors of counties, and to repeal Section 2769-a of the Code, relating to the
same subject. [H 218]

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding a new section
numbered twenty-seven hundred sixty-nine, as follows:
Section 2769. Compensation of Supervisors.—(a) Each member
of the board of supervisors of each county shall be allowed and paid out
of the county levy an annual salary, to be fixed as herein provided, for his
services in attending the meetings of the board and in discharging the
duties imposed by law upon him.
(1) The total annual amount to be allowed as compensation for the
entire membership of the board of supervisors of each county shall be
fixed by the judge of the circuit court of such county, in term or vaca-
tion, by an order entered of record in the common law order book, within
the following limits; in any county having a population, according to the
last preceding United States census, of not more than twenty thousand,
such total shall not exceed twelve hundred dollars; in each county having
In excess of twenty thousand but not more than twenty-six thousand,
such total shall not exceed fifteen hundred dollars; in each county hav-
ing in excess of twenty-six thousand but not more than forty thousand,
such total shall not exceed two thousand dollars, provided that in each
such county having seven magisterial districts, such total shall be not less
than seventeen hundred and fifty nor more than two thousand one hun-
dred dollars ; and in each county having in excess of forty thousand such
total shall not exceed twenty-five hundred dollars, except that in any
county having a population in excess of forty thousand, adjoining a
county having a density of population in excess of one thousand per square
mile according to the last preceding United States census, the annual
salary of each member of the board of supervisors shall not be less than
six hundred dollars and not more than twelve hundred dollars, exclusive
of mileage, and except that in each county having in excess of forty thou-
sand and having eight or more magisterial districts, such total shall not
be less than twenty-two hundred dollars, and except that in counties in
excess of fifty-five thousand in population such salary shall not be less
than twenty-five hundred dollars. Provided, that counties having a popu-
lation of thirty thousand inhabitants or more and which board of super-
visors of same has the duty of supervising the operation of ferries owned
in whole or in part by the county, the compensation of each member of
the board of supervisors shall be not less than five hundred dollars per
annum for each member of the board and not more than eight hundred
dollars per annum for each member of the board and the compensation
shall be provided for in accordance with the provisions of this section;
and provided further, that in any county having a population of not more
than thirty thousand and adjoining a city having a population of more
than one hundred thousand but less than one hundred and fifty thousand,
the annual compensation of each member of the board of supervisors
shall be not less than two hundred fifty dollars nor more than five hun-
dred dollars, and in any county having a population of not less than thir-
teen thousand nor more than thirteen thousand six hundred, and having
five magisterial districts, the compensation of each member of the board
of supervisors shall be not less than two hundred and forty dollars nor
more than three hundred and fifty dollars; and provided further, that in
counties adjoining cities lying wholly within the State of Virginia having
a population of not less than one hundred and seventy thousand inhabi-
tants according to the last preceding United States census the compensa-
tion of each member of the board of supervisors shall not be less than
three hundred dollars nor more than seven hundred fifty dollars per
annum. :
For the purposes of this section the population referred to shall be that
shown by the last preceding United States census.
(2) The annual compensation to be allowed each member of the
board of supervisors of any county shall be determined by dividing the
total amount allowed the entire board in accordance with the provisions
of the last preceding paragraph by the number of supervisors in the
county. Provided, however, in any county that has a density of popu-
lation of more than fifty-three and less than fifty-five inhabitants to the
square mile within the geographical boundaries of which is located a
city on a navigable river having a population of not less than ten thou-
sand nor more than twenty thousand inhabitants by the last United States
census, the total annual amount to be allowed as compensation for the
entire membership of the board of supervisors of such county shall be
fixed in accordance with the terms of this act at not more than two thou-
sand dollars; and provided further, that in any county having therein
properties of public service corporations assessed for taxation at an ag-
gregate valuation of more than six million dollars, the annual compen-
sation of each member of the board of supervisors shall be not less than
three hundred dollars nor more than four hundred and fifty dollars;
and provided further that in any county that has a population of not less
than seven thousand inhabitants and a density of population of not less
than twenty-six per square mile, in which county is located a port on a
navigable river, the total annual amount to be allowed as compensation for
the entire membership of the board of supervisors of such county shall
be fixed in accordance with the provisions of this act at not more than
twelve hundred dollars ; and provided further, that in any county, adjoin-
ing the State of North Carolina and having a population of more than
twenty thousand, but less than twenty-six thousand according to the last
preceding United States census, and having located partially within its
boundaries a town lying partly in such county and partly in another
county, the total annual amount to be allowed as compensation for the
entire membership of the board of supervisors shall be fixed in accord-
ance with the provisions of this act at not more than two thousand dol-
lars ; and provided, further, that in any county adjoining two cities of the
first class, one of which is located within the geographical boundaries of
said county, and on a navigable river, and in which county 1s located a
military camp or fort, the annual compensation of each member of the
board of supervisors shall be not less than three hundred dollars nor
more than three hundred and fifty dollars.
(b) In addition to the foregoing compensation each member of the
board of supervisors shall be allowed and paid out of the county levy five
cents for each mile of travel required in going to and returning from the
place of meeting of the board, provided that only one mileage shall be
allowed for each term or meeting of the said board, and provided, further,
that mileage shall not be allowed for more than twenty-four meetings in
any year.
(c) Nothing in this section shall apply to any county which has
adopted or may hereafter adopt any form of county organization and gov-
ernment provided for in sections twenty-seven hundred seventy-three-a
to twenty-seven hundred seventy-three-n, both inclusive, of the Code of
Virginia.
2. That section twenty-seven hundred sixty-nine-a of the Code of
Virginia is repealed.
