Chap. 70.—An ACT to amend and re-enact Section 5 as heretofore amended, and
Section 6 of an act approved March 21, 1930, providing a new charter for the
Town of Colonial Heights, Chesterfield County, Virginia, relating to its admin-
istration and government, so as to graduate terms of office of members of the
council, and to fix the term of office of mayor at four years. [H B 146]

1. Be it enacted by the General Assembly of Virginia, That section
five as heretofore amended, and section six of an act approved March
twenty-first, nineteen hundred and thirty, providing a new charter for
the Town of Colonial Heights, Chesterfield County, Virginia, be amended
and re-enacted, as follows: .
Section 5. The administration and government of the Town of
Colonial Heights shall be vested in one principal officer, styled the mayor,
and one board, composed of five persons styled the council of the Town of
Colonial Heights, together with a commissioner of the revenue, a clerk,
treasurer, and a chief of police, whose qualifications to hold such offices,
respectively, shall be the same as is required of persons to vote and hold
office under the Constitution and laws of the State of Virginia. The mem-
bership of said council shall be divided into two classes to be known and
designated as Class One, composed of three members, and Class Two,
composed of two members, and at the next annual election for town of-
ficers three of those elected, selected by lot, shall constitute the Class One
and serve for terms of two years each, and the remaining two shall serve
for terms of four years each, and thereafter all members of the council
shall be elected for terms of four years. Vacancies in the council shall be
filled within thirty days, for the unexpired term, by a majority vote of the
remaining members thereof.
Section 6. Only the mayor and councilmen in office at the time of
the passage of this act shall continue in office until the first day of Sep-
tember, nineteen hundred and forty-two, or until their successors are
elected and qualified. The election for mayor and councilmen shall be
held on the second Tuesday in June, nineteen hundred and forty-two,
and that for councilmen every second year thereafter, and that for mayor
every four years thereafter. And the mayor and the councilmen elected
under this act shall enter upon the duties of their respective offices the
first day of September succeeding their election.
2. An emergency exists and this act is in force from its passage.
