Chap. 388.—An ACT to amend the Code of Virginia by adding thereto a new section
numbered 5790-a, providing how claims to damages for personal injury to
infants or insane persons, where death did not ensue, may be compromised.

1. Be it enacted by the General Assembly of Virginia, That the
Code of Virginia be amended by adding thereto a new section numbered
fifty-seven hundred and ninety-a, as follows:
Section 5790-a. In any case of personal injury to an infant, idiot or
an insane person, caused by the wrongful act, neglect or default of any
person or corporation, where death did not ensue, the guardian of such
infant or the committee of such insane person, with the approval of the
judge of the court wherein an action might be brought for the recovery of
damages on account of such injury, may compromise any claim for such
damages. Such approval may be applied for by the guardian of such infant
or the committee of such idiot or insane person, or by the person who
caused the injury, on petition to the said judge, in term or vacation, stating
the compromise, the terms thereof, and reasons therefor, and convening
the parties, and in case such petition is filed by the person who caused the
injury, the said judge shall appoint a guardian ad litem for such infant,
idiot or insane person and shall cause the parents or guardian of such
infant, if such there be within the jurisdiction of the court or the commit-
tees of such insane person or idiot if such there be, to be made parties to
the proceedings. The proceedings on any such petition, the effect thereof,
and the disposition of the papers in the case, where the proceeding is in
vacation, shall be in accordance with the applicable provisions of section
fifty-seven hundred and eighty-nine and section fifty-three hundred and
thirty-two of the code; provided that nothing in this act shall be construed
to affect the provisions of section fifty-three hundred and thirty-two and
fifty-three hundred and forty-two of the Code of Virginia.
