Chap. 355.—An ACT to continue the Division of Aeronautics in the Department o!
Corporations; to prescribe, for the State Corporation Commission and the State
Highway Commission, certain powers and duties relating to aviation and aviatior
facilities ; and to repeal Chapter 368 of the Acts of the General Assembly of 1938
as amended, and appropriating the unexpended balance of the aviation func
heretofore collected under the provisions of said chapter. [H B 133]

1. Be it enacted by the General Assembly of Virginia, as follows
Section 1. Division of Aeronautics continued.—The Division o:
Aeronautics, heretofore established as a division of the Department o:
Corporations, is hereby continued. Through the said division it shall bi
the duty of the State Corporation Commission to administer the laws o:
the Commonwealth relating to the licensing of airports, landing fields
aircraft, airpilots, and airplane and engine mechanics, to the construction
maintenance and improvement of public airports, landing fields and othe:
aviation facilities, and for the promotion of aviation in the interest of th
public. a -
| Section 2. Within the limits of appropriations made for such pur
pose, the State Corporation Commission is authorized to purchase an air
plane for the use of the Division of Aeronautics, to purchase land for an
to construct, maintain and improve airports, landing fields and othe
aviation facilities within the State for the promotion of aviation in th
interest of the public, and neither the appropriation nor any part thereo
may be transferred for, nor used for any other purpose than those speci
fied in this act ; provided that the unexpended balance of the aviation fun:
heretofore collected and converted into a special fund for the administra
tion of aviation laws by the Division of Aeronautics of the Department o
Corporations is hereby appropriated to said division in addition to th
amount provided in the general appropriation bill for the same purpose:
The said Commission shall prescribe reasonable regulations for the opera
tion of all airports, landing fields and other aviation facilities constructec
maintained or improved in whole or in part with funds appropriated by th
General Assembly. Subject to such regulations, the public shall hav
access to every such airport, landing field and facility.
Section 3. The State Highway Department is authorized to build
roads to airports and landing fields open to public use, and to pay out of
highway funds the cost of such roads; to build or to cooperate with the
State Corporation Commission through the Division of Aeronautics, in
the construction, maintenance and improvements of airports, landing fields
and other aviation facilities licensed for public use, and for these pur-
poses, to furnish equipment, labor, engineering and materials at actual
cost, to the Division of Aeronautics.
Section 4, Be it further enacted, That Chapter three hundred and
sixty-eight of the Acts of the General Assembly of nineteen hundred and
thirty-eight, as amended, be, and it is hereby, repealed.
Section 5. An emergency existing, this act shall take effect from
its passage.
