Chap. 337.—An ACT to amend and re-enact Section 246 of the Code of Virginia, so
as to permit any candidate, even though declared a nominee, to have his name
printed on the ticket. [H B 354]

_. 1.. Be it enacted by the General Assembly of Virginia, That section
two hundred and forty-six of the Code of Virginia be amended and re-
enacted, as follows: ;
Section 246. When no primary shall be held—Whenever within
the time prescribed by this chapter there is only one declaration of candi-
dacy in a political party for the nomination for any .office, the name of
the person filing such declaration shall be declared the nominee of such
party for the office for which he has announced his candidacy. When,
however, a primary is being held for other offices to be filled, any candi-
date who shall have been declared a nominee, due to absence of opposi-
tion, may have his name printed on the ballot by his request. No primary
shall be held for the nomination of candidates for office when the authori-
ties of a political party acting within the discretion vested in them by this
chapter shall require the nomination to be made otherwise.
