Chap. 334.—An ACT to amend and re-enact Section 126 of the Code of Virginia,
relating to surveyors and superintendents of the poor, and Section 127 of the
Code of Virginia, as amended, relating to election and term of office of certain
district officers, to omit provisions therefrom as to superintendents, and over-

1. Be it enacted by the General Assembly of Virginia, That section
one hundred and twenty-six, and section one hundred and twenty-seven
as amended, of the Code of Virginia, be amended and re-enacted, as fol-
lows: — | |
Section 126. Surveyors; how appointed, term of office —The judge
of each circuit court in term-time or vacation shall, upon the recommen-
dation of the board of supervisors in each county in which he holds court,
in the month of November, nineteen hundred and nineteen, and every
fourth year thereafter, or whenever a vacancy occurs, appoint for each
county in which he holds his court, one county surveyor; but he may, if
he thinks proper, for reasons entered of record, reject the recommenda-
tion, and unless the board of supervisors recommend another person suit-
able, in his opinion, for said office, within thirty days after their first
recommendation has been rejected, he shall fill said office by his own ap-
pointment in term-time or in vacation. Such officer shall enter upon the
duties of his office upon the first day of January next succeeding his ap-
pointment, and shall hold his office for the term of four years, except that
in case of an appointment made to fill a vacancy, the term of office shall
commence as soon as the officer shall qualify, and shall continue for the
unexpired portion of the term of four years hereinbefore specified.
Section 127. When district officers to be elected; term of office.—
In each magisterial district there shall be chosen by the qualified voters
thereof at the general election to be held on the Tuesday after the first
Monday in November, in the year nineteen hundred and nineteen, and
every four years thereafter, one supervisor, one constable, and three
justices of the peace, who shall hold their offices for the term of four years.
