Chap. 315.—An ACT to relieve the owners and operators of motor vehicles, trailers
and semi-trailers used for agricultural or horticultural purposes from certain
requirements of law with respect to registering and licensing such vehicles,
under certain conditions, to prescribe the rights and duties of the owners, lessees
and operators of such vehicles with respect to fuel tax refunds, and to repeal
provisions of law inconsistent with this act. [S B 198]

1. Be it enacted by the General Assembly of Virginia, as follows:
Section 1. No person shall be required to obtain the annual regis-
tration certificate and license plates, or to pay the fee prescribed therefor,
pursuant to the provisions of the Motor Vehicle Code of Virginia, for
any truck upon which is securely attached a machine for spraying fruit
trees and plants of the owner or lessee of said truck or for any motor
vehicle, trailer or semi-trailer, as those terms are defined in the said Code,
which is used exclusively for agricultural or horticultural purposes on
lands owned or leased by the owner thereof and which is not operated on
or over any public highway of this State for any purpose other than for
the purpose of operating it across a highway or along a highway for a dis-
tance of not more than one mile, from one point of the said owner’s land to
another part thereof, or for the purpose of taking it or other fixtures
thereto attached, to and from a repair shop for repairs. Provided, how-
ever, that before any such motor vehicle, trailer or semi-trailer shall op-
erate upon any public highway for the purpose of taking it to or from
a repair shop, the owner or operator thereof shall apply to and obtain
from a highway patrolman or a licensed agent of the Director of the Di-
vision of ‘Motor Vehicles, who are authorized and directed to issue the
same, a written permit specifying the place to and from which said equip-
ment is to be moved and the date upon which permit is to be effective, and
provided further that no such permit shall be valid for more than seven
days after the date of its issuance, or shall authorize the taking of such
vehicle to a repair shop further than the nearest convenient place where
such repairs can be made. This section shall have no application, how-
ever, with respect to the requirements of the Motor Vehicle Code of Vir-
ginia with respect to title certificates and fees therefor.
Section 2. The owner or lessee of any motor vehicle, whether it 1s
registered and licensed under the provisions of the Motor Vehicle Code of
Virginia or not, shall be entitled to fuel tax refunds, under the provisions
of the Motor Fuel Tax Act of Virginia, on all motor fuel used in the
operation of such vehicle while it is being used exclusively for agricultural
or horticultural purposes on lands owned or leased by the owner or lessee
of such vehicle and not operated on or over any public highway for any
purpose other than for the purpose of moving it in the manner and for
the purposes hereinbefore authorized, provided, the owner or lessee of
any motor vehicle which has been licensed under the provisions of the
Motor Vehicle Code of Virginia shall not be entitled to fuel tax refunds
for fuel used in said licensed motor vehicle until he has delivered the
license tags furnished for said vehicle to the Clerk of the Circuit Court of
his county, who shall issue a receipt therefor and be entitled to a fee of
twenty-five cents, or to the nearest office issuing licenses, the agent in
charge of which shall likewise issue a receipt therefor, but without charge,
the said owner or lessee of such motor vehicle being entitled to fuel tax
refund on fuel used in the operation of such vehicle for such time as said
tags are left with the said clerk or agent. Said owner or lessee may sur-
render said receipt to said clerk or agent at any time, who shall forthwith
return said tags and notify the Director of Motor Vehicles.
2. Be it further enacted, That all provisions of law inconsistent
with the provisions of this act are repealed to the extent of such incon-
sistency.
