Chap. 257.—An ACT to amend the Code of Virginia by adding a new section num-
bered 3172-a, to make it unlawful to use haul seines in a certain portion of the
Rappahannock River, or in its tributaries, under certain conditions ; to prohibit
leaving dead fish on the shore or throwing same into the water ; and to make
any violation of this act a misdemeanor and to prescribe the punishment.

1. Be it enacted by the General Assembly of Virginia, That the
Code of Virginia be amended by adding a new section numbered thirty-
one hundred and seventy-two-a, as follows:
Section 3172-a. Unlawful to Use Haul Seines, or to Leave Dead
Fish on Shore or Throw Same in Water, in Certain Portions of the
Rappahannock River. or in Certain of Tte Trihntariec: Vinlatinn Wed.
, Misdemeanor; Punishment.—It shall be unlawful for any person, urm
sr corporation to use any haul seine within one hundred yards of mean
ow water mark, or three feet of water in depth at mean low water,
whichever shall be closer to the shore, or over any oyster ground held
under lease from the Commonwealth of Virginia and marked as required
by law in the waters of the Rappahannock River east of Downing Bridge
at Tappahannock, and in its tributaries east of Downing Bridge. No dead
fish, killed in such haul seining, shall be left on the shore or thrown into
the water. The restriction hereinabove set forth as to hauling seine within
4 certain number of feet of shore or in water of a certain depth shall be
inapplicable where the unrevoked written consent of the adjacent land
owner has been obtained.
Any person violating any provision of this section shall be deemed
guilty of a misdemeanor, and upon conviction shall be punished by a fine
of not less than ten nor more than one hundred dollars, or by confinement
in jail for not less than ten nor more than sixty days, or both.
