Chap. 240.—An ACT to amend and re-enact Sections 7, 16 and 21 of an act en-
titled “An act to provide a new charter for the town of Occoquan and to repeal
all other acts inconsistent with this act.”, approved March 22, 1930, relating to
meetings of the town council ; and to further amend the said act by adding a new
section numbered 18-a, authorizing the town to levy license taxes on certain
motor vehicles. [H B 123]

1. Be it enacted by the General Assembly of Virginia, That sec-
tions seven, sixteen, and twenty-one of an act entitled “An act to provide
a new charter for the town of Occoquan and to repeal all other acts in-
consistent with this act.”, approved March twenty-second, nineteen hun-
dred and thirty, be amended and re-enacted, and that the said act be
further amended by adding a new section numbered eighteen-a, so that
the said amended sections and the said new section shall be as follows:
Section 7. The mayor shall preside over the meetings of the coun-
cil. He shall have no right to vote in the council except, that in every case
of a tie vote of the council, the mayor shall be entitled to vote. He shall
be entitled to receive the same fees for the issuance of warrants and the
trial of causes as are allowed under general laws to justices of the peace.
Section 16. The council shall hold regular or stated meetings once
a month at such time as shall be fixed by their body. Extra or special
meetings may be called by the mayor or by three members of the council;
but the purpose for which a special meeting is called shall be stated in
writing. Two members of the council and the mayor shall constitute a
quorum for the transaction of business. In the absence of the mayor
three members of the council shall constitute a quorum for the trans-
action of business. If any member of the council shall be voluntarily
absent from three regular meetings of the council consecutively, his seat
may be deemed vacant by resolution of the council, and thereupon his
unexpired term shall be filled according to the provisions of this act.
(a) The council shall be the sole judge of the election and qualifi-
cation of its members, and it shall have the power to fill all vacancies in
its own body and in any other office of the town. It may elect such com-
mittees for the various departments of the town as it may desire from its
own inembers. Such committees shall be appointed at the regular meeting
in September, nineteen hundred and forty-one, and vacancies shall be
filled by the council as they occur.
Section 18-a. The council may require the owners of motor ve-
hicles, trailers, and sub-trailers, residing in, or having an office or place
of business in the town, to obtain licenses for the privilege of operating
such vehicles in the town, such licenses to be issued and the fees therefor
fixed by the council.
Section 21. The council may prohibit the erection of frame build-
ings in any part of said town designated by it as the fire area; may pre-
scribe and locate building lines and regulate the height and construction
of buildings; may require building permits and may make reasonable
rules and regulations regarding the building and construction of houses
in the town.
